There are three basic ways to determine who Local Law 84 applies to:

• Basic square footage of a building – Any covered structure more than 50,000 gross square feet comes under the law. 
• Combination of structures on a single tax lot – To determine if a property with more than one structure is affected by Local Law 84; calculate the total gross square footage of all buildings. If the total square footage of all buildings is more than 100,000 then the property is subject to Local Law 84. 
• Condominium complex governed by a single board – If a condominium complex exceeds 100,000 gross square feet, regardless of tax lots included; it is subject to Local Law 84, with the exception of 1-3 family homes classified as Class One under the Property Tax Law. 

Properties that are included under Local Law 84 Benchmarking that do not become compliant are subject to financial penalties of as much as $2,000.
