Oil Pipelines and Native Nations

Are the Native Nations in America independent and sovereign nations? There is much myth and misunderstanding with regard to this question, yet the Constitution for the United States of America is quite clear on the issue: Article I, Section 8, Clause 3 states "To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;"

Energy Transfer Partners, L.P. is NOT a State, a forerign Nation, nor an Indian Tribe - yet the federal judiciary are siding with them.

The U.S. Army Corps of Engineers is NOT a State, a foreign Nation, nor an Indidna Tribe - yet the federal judicaciary are siding with them. 

Governor Jack Dalrymple of North Dakota has declared a State of Emergency, and has now called upon the North Dakota National Guard to assist his law enforcement agencies with regard to whatever they are doing AGAINST the many Native Nations who are protesting the Dakota Access Pipeline. He is wholly ingnoring the U.S. Constitution, specifically the section cited above, as well as Article VI, Clause 2 "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding."
