Hello folks and thank you for joining me once again at the ADR-NOW! Internet Radio Webinar.  I am your host, Anthony Johnson. 

In this episode, we will discuss the importance of knowing who your Trustee is if you live in a NON-JUDICIAL FORECLOSURE STATE.  Remember, in a non-judicial foreclosure state, there is no court process.  You may not even receive a NOTICE OF DEFAULT if the Trustee would move to initiate foreclosure proceedings due to nonpayment of your mortgage.  The only thing that is required is for the Trustee to file notice with the county recorder's office of the intent to initiate foreclosure proceedings and that is considered "constructive notice."

The question then becomes: Is the person who filed the Notice of Default with the county recorder's office the true Trustee?  Is the Trustee the ORIGINAL TRUSTEE?  DULY APPOINTED SUBSTITUTED TRUSTEE?  Or acting as AGENT for the TRUSTEE or beneficiary under the original Deed of Trust?
