Parents usually know the people that they would want to raise their minor children should something happen to the both of them (i.e., guardians); however, they may not know how to memorialize these wishes in a way that courts will recognize after they are gone. If parents do not nominate guardians, default rules govern who may petition the court and be responsible for children and inherited assets – these rules may not conform with parents’ wishes. In this podcast, attorney Brian Warens discusses how to nominate guardians, planning for children’s financial needs, and provides a brief overview of the guardian appointment process.
