My career with the former INS spanned some 30 years. I began my career as an Immigration Inspector, assigned to John F. Kennedy International Airport in New York and then,
I was assigned as an Adjudications Officer for one year, conducting interviews to determine the bona fides of marriages in conjunction with petitions filed by U.S. citizens and lawful immigrants on behalf of their alien spouses to accord them lawful immigrant status.
in 1975 I became a Special Agent (Criminal Investigator). During my career I was assigned to every squad within the Investigations Branch of the New York District Office. From 1988 until 1991 I was assigned to the Unified Intelligence Division of the DEA in New York City. In 1991 I was promoted to the position of Senior Special Agent and assigned to the Organized Crime, Drug Enforcement Task Force (OCDETF).
I have testified before approximately 15 Congressional hearings on issues involving immigration, especially its nexus to national security and criminal justice. I provided testimony to the 9/11 Commission and have worked as an expert witness at trials in which immigration was at issue.

"Sadly, as so many investigations have revealed, there exist in Florida a substantial number of abusive "Professional For Profit" guardians and lawyers who have manipulated the Guardianship system and repeatedly exploited their positions to loot the very estates they are sworn to protect.
It is not just elders who are vulnerable--anyone at any age--can be deemed "incapacitated" --even seemingly healthy independent adults--and become " A Ward of the State"
A powerful subgroup of For Profit Guardians has used loopholes in the law and very weak Court moitoring to wreak terrible harm on Wards and their Families while they enrich themselves with exorbitant fees and horribly abusive tactics.
Abusive Guardians twist and subvert the laws giving them total power over the (allegedly) vulnerable in our society and instead of helping the frail among us, use the power of the law to strip away precious Civil Rights and plunder estates, isolate families who get in the way, and in the process destroy lives. They use the very laws intended to help people to destroy innocent people and their families."
Dr. Sam Sugar joins us this evening! We will be talking at length about patients rights. When are they applicable? When do they end? At what point does HIPAA end and the de facto death certificate referred to as guardianized "ward" begin?
If you are hospitalized due to illness and have not been declared a "ward", what right does the state and its agencies and agents have to intervene in your care or decisions?
Dr Sugar has also helped to author a bill in the Florida legislature FL SB412 which calls for revision of standing statutes and protection from predators working within the probate/family court system.
Why should anyone, by virtue of disability, and/or unproven mental incompetence lose all of their Constitutional protections and rights?
Why should anyone be "dead in the law" because they were deemed an "ward" of the court?
At what point does the individual cease to exist and to have rights, especially when no "team of experts" has determined them to be incapacitated?
Why should vulnerability allow a predator to loot the estates, take SS and veterans checks, personal belongings, valuable property for their own purposes.
Dr.Sam Sugar has much to say about all of this.

Linda Kincaid, MPH is nationally recognized as an authority on civil rights of the elderly and disabled. She has presented training at conferences across the country. At the Aging in America conference in March, Linda will present a 90-minute workshop on Isolation: Elder Abuse in Long-term Care.
Tonight, Linda will discuss two cases of elder abuse by Public Guardians in California. ABC7 in San Francisco recently covered the story of Reta Cook, who fled the Santa Clara County to escape conservatorship. Although Reta was no longer in the county, the Public Guardian continued deplete her assets for services that were not provided. Listeners are encouraged to view the segment and post their comments to the story.
Linda will introduce listeners to the Margarita Zelada conservatorship in Monterey County. While visiting her daughter in Pacific Grove, Margarita was forcibly taken from the daughter’s home and placed in a facility where she is allowed no visitors.
Advocates pointed out that false imprisonment and forced isolation are violations of Margarita’s civil rights. The Public Guardian retaliated by going to court to strip Margarita’s right to have contact with advocates.
The Public Guardian recently filed a motion that could permanently strip Margarita’s right to have any contact with her daughter. The motion appears to be retaliation for continued media coverage of the civil rights violations.
Our guest is Susan Wagner, President and co-founder of Equine Advocates. Founded in 1996, Equine Advocates has helped rescue thousands of equine from slaughter, abuse and neglect.
Equine Advocates originated and participated in many televised and print undercover investigations in the U.S. and Canada to expose horse slaughter auctions, horse slaughterhouses, the tragic fate of most camp horses, the abusive treatment of many mules, buggy horses and work horses by some Amish farmers, the miserable lives of PMU mares who are continually impregnated and turned into 4-legged drug machines to produce the drugs, Premarin, PremPro and Premphase, the cruel urban carriage horse trade and other informative reports exposing equine abuse and other forms of exploitation.
In 2004, Equine Advocates opened the Equine Advocates Rescue and Sanctuary on 140 acres in Chatham, NY, now home to 85 equine (with 3 wild horses, including Hayden, who was rounded up by the BLM in Montana). In 2006, they opened the Equine Education Center, where they hold lectures and symposiums on equine care, humane treatment, natural horsemanship and the enforcement of the cruelty laws. They also host the annual American Equine Summit.
