Shackles an affront to 'dignity and decorum' of court, appeals panel rules

An appeals court Tuesday struck down a policy of routinely handcuffing and shackling pretrial detainees appearing before judges in the San Diego-based federal court district.
A three-judge panel of the U.S. 9th Circuit Court of Appeals said the Southern California district has not adequately justified its policy, adopted by the district judges in 2013 on the recommendation of the U.S. Marshals Service. The restraints include leg shackles and handcuffs linked to a belly band by a 15-inch chain.

Many people are unaware that teens and preteens can be brought from detention and correctional facilities to juvenile court in leg irons, belly chains and handcuffs, often even before a youth is charged with any wrongdoing. The practice of shackling rarely occurs with adults in criminal court, but is a common sight in juvenile courts across the country and its use is frequently unrelated to any identified safety or flight risks. Shackling interferes with due process and increases poor outcomes for youth. Numerous jurisdictions have successfully reduced or stopped the use of shackles without increasing risk to their communities. On this episode of Spotlight on Youth, guests will discuss why shackling is harmful, explain the national movement that exists to end the indiscriminate practice, and share their efforts and experiences in changing the norm for kids in juvenile court.

The language used in the book is profane, affection yet radically honest as it captures the familiar and often ‘unspoken’ tribulations of putting your child down for the night. Also described as beautiful, subversive and pant-wettingly funny, this book is meant for new, old and expectant parents. It should probably not be read to your child!
