    Tonight- Americans for Safe Access published a white paper entitled Third Time The Charm?' which focuses on the existing medical marijuana laws and efforts in each state and how they may comply with the Cole memo and DOJ policy, including HB4271 in Michigan which will be heard December 5th in the House Judiciary Committee.


     


    Mike Liszewski- legislative analyst from ASA in DC, and who was heavily involved with the recent ASA report, will join us to discuss this recent publication, possible future reports to be published by ASA and his and ASA's assessment of HB4271.

    Tonight- Federal POWs Jerry and Jeremy Duval have their appeal heard in the US Court of Appeals today in front of family, friends, and advocates from around the country. The Duvals were served a state warrant which failed to mention previous knowledge of the cannabis garden by local officials. Both men were ultimately convicted in Federal Court on Friday April 20th at 4:20 PM. Senator Rick Jones has recently introduced SB 736 which, in part, would allow courts to order an independent medical evaluation and verify medical marijuana certifications in cases where children are involved.

    - Attorney Andy Greenlee from Brownstone Law in Florida, who represented the Duvals today in Federal Court, will discuss the case, the focus of the arguments and his thoughts on how things went today.     Tonight- Recently elected Detroit City Councilman and former State Representative, George Cushingberry Jr., along with cannabis reform activist Richard Clemente were involved in a controversial traffic stop that resulted in heavy media attention. Also, local Michigan activist, and MI Norml board member, visits DC, and was able to sit in attendance and observe the council vote to decriminalize cannabis. He was also able to discuss reform issues with Michigan Reps Debbie Stabenow and Gary Peters, as well as national advocates from Americans for Safe Access and the Marijuana Policy Project. A visit with POW Ryan Basore, friend of PGT and the community at large, was included in the trip, as well.

    Tonight- The state of Washington, one of two to successfully win cannabis legalization at the ballot in 2012, is preparing to implement and govern the state's new legal cannabis market. What does this mean to the existing medical marijuana program there and how is the regulatory scheme in Washington viewed by the Federal government? Also the Michigan Court of Appeals has issued a published opinion in the case of People v Hartwick in which section 4 protections and the affirmative defense of section 8 in the Michigan Medical Marihuana Act were denied. The COA also upheld the disqualification of District Court Judge Somers in Dearborn due to comments he made about cannabis and the MMMA, in a previous case.


     Joining us tonight will be Kari Boiter, nationally recognized medical marijuana activist and champion for drug war prisoners and criminal justice reform, from Seattle, WA.


     


     Also calling in will be friend of the show and attorney Neil Rockind "The Rockweiler" of Rockind Law who is responsible for having the biased Judge Somers disqualified from a medical marijuana case. Neil will also join Michael in discussing the real meaning and implications of the published COA opinion in P v Hartwick.

    Tonight- Colorado experiences it's historic first week of cannabis sales for personal use. Washington state is months away from implementing its new regulatory system and Alaska may join the ranks of legalized states as early as August. 


    Dr Bob Townsend of Denali Health Care, who recently authored the blog piece 'The Forgotten Medical Marijuana Patient' will discuss the necessary standards for engaging in medical marijuana recommendations and developing a proper relationship with the patient, as well as thoughts and goals for the medical marijuana community for 2014.


    Dan Riffle, Director of Federal Policy for the Marijuana Policy Project, will rejoin is this week and continue the discussion of the national reform landscape including Colorado, Washington and Alaska. 


    And, veteran cannabis reform advocate Adam Brook, well known freedom fighter and long time MC of Hash Bash in Ann Arbor is back on the scene and will share with us his history in activism and what his plans are for the upcoming year.

    Planet Green Trees Episode 179- Carruthers - Entrapment/ Year in Review

    Tonight- An entrapment defense was successfully argued in a case involving an undercover officer posing as a patient in order to gain access to the services of a Southfield, MI dispensary. House bills 4271 and 5104 head to the Senate after passing in the House by votes of 95-14 and 100-9 respectively. Also, this will be the last Planet Green Trees broadcast of the year and will resume Thursday Jan. 3rd, 2014.


    Earl Carruthers, defendant in the infamous Court of Appeals decision which brought into question the protections for concentrates and edibles, will join us to discuss his other dispensary case, which was recently dismissed in circuit court.


    Representative Mike Callton, Republican from Nashville, who introduced the Provisioning Center Act HB4271, and saw it through an overwhelming vote of support in House, will call in to discuss the process of working on the bill over the last year and what will happen from here.

    Tonight- Medical marijuana bills 4271 and 5104 pertaining to distribution centers and marijuana edibles and concentrates, passed the MI House of Representatives today by a huge margin, sending the bills to the Senate with some momentum. Some amendments were made to both bills, just prior to passage. What did it take to get these bills passed with such heavy support, and how do they look movng over to the Senate for consideration?


     


    Robin Schneider, the Legislative Chairwoman for the National Patients Rights Association, the organization working directly with a lobbyist in the MI legislature on behalf of the patient friendly bills 4271 and 5104 will join us along with Representative Callton who introduced HB 4271 The Provisioning Centers Act, as well as Chris Lindsey who is Michigan's liaison from the Marijuana Policy Project.

    Tonight- The Michigan House Judiciary Committee heard testimony today on medical marijuana bills HB4271, HB5104, and SB 660 in preparation for a second hearing in which the bills are expected to be voted on Tuesday Dec 10. SB 660 would allow large commercial cannabis gardens which would be used as supply to be distributed through pharmacies. HB 4271 a The Provisioning Centers Act would allow local governments to accept or reject testing labs and distribution centers which would be supplied by the existing caregiver system, and HB5104 would allow for concentrated and edible forms of medical cannabis. HB5104 was introduced by Rep Kowall in response to a court ruling in People v Carruthers that determined that only the leaf and flower are protected forms of medicine under the Act.

Tonight- The Michigan State Senate passed SB660 on Wednesday Nov. 13, which would allow medical marijuana patients the option of obtaining up to two ounces per month of tested cannabis from a pharmacy in lieu of participating in the Michigan Medical Marihuana Program. Also Michigan representatives and senators, along with a representative of the National Patients Rights Association (NPRA), visited the Canadian company in Saskatoon, responsible for the powerful lobbying effort behind the "pharma grade" marijuana bill.
    Joining us tonight will be the Michigan Senate Minority Leader Gretchen Whitmer from East Lansing, who spoke in opposition to SB660 on the Senate floor and offered  amendments to the bill that would include "tie barring" House Bills 4271 a local option bill for dispensaries, and 4623 a bill to decriminalize adult use of small amounts of cannabis, which were defeated. Robin Schneider, the Legislative Chairwoman for the NPRA visited the Prarie Systems operation in Saskatoon Canada along with Michigan State Representatives and Senators. While there, Robin spoke with members of the Canadian Parliament and those responsible for growing and providing medical marijuana to Canadian patients.
