In the computer age, 99% of all documents are created andn stored electronically. Electronic evidence has been described as e-mail, spreadsheets, word processing documents, audio, video, or any other content that has metastasized in a digital format. The fact-finding process will require you to uncover electronic evidence, especially if you are a party to a foreclosure situation. Most mortgages have MERS, the Mortgage Electronic Registration System, Inc. as nominee for the original lender, its successors and assigns. MERS has represented in Courts that its sole purpose is as a system to track mortgages. It has stated that it does not do the entries on the electronic repository itself, but the lenders and services do. When the all-important "Assignment of Mortgage" or "Assignment of Security Deed of Trust" is executed, it is the member servicer or lender that goes to the website, downloads the necessary forms, completes the forms and then takes it to the designated "MERS Officer" to sign.
Because MERS is an electronic repository and database that stores information, it is prudent that you have a grasp, the nuts and bolts, of what electronic evidence is all about.

March 14, 2012 - Register Thigpen sued MERS, the document processing company Lender Processing Services, and several banks and loan servicers, using as evidence the contents of his register of deeds’ office. Grace Ross (MA) - Coordinator at Mass Alliance Against Predatory Lending will discuss a bill that has been unanimously approved by the Massachusetts Senate (Bill S.1987) - a bill that would restore the titles of foreclosed properties to homeowners. Grace said the following about this bill:"This does NOT fix titles for those foreclosed. It wipes out the "former" owner's claims if you don't file your suit & a copy in the Registry in 1 to 3 years so the next owner keeps the home no matter what you can prove later"
We will also discuss some break through information on wider foreclosure issues.

Lee Perry (CA) - fighting foreclosure fraud on his own since 2009. His case is now in the Appellate Court. Lee would also talk about importance of this legislation - AB1240. Lee's suggesting that California homeowners contact Hon. Brian Jones (R-Dist 71) of the state Assembly to actively promote this bill. This bill corrects statutory language that will require the recording of deed of trust loan assignments if the assignee wants to preserve the option of non-judicial foreclosure.
