It ends up being another "I told you so" edition of real estate realities. Evictions are on the rise as property owners who turned to renting have seen their prices recover.
This was a concern I shared more than a year ago as more and more organizations who had never been in the home renting business were entering into it because there was money to be made there. Of course, I am all for folks doing what they want with their investments, but remember, the government has FORCED many bulk purchasers of foreclosed homes to rent them for some period of time.
In this weeks show we will revisit this and discuss the potential bottom falling out of the rentals market in some areas.

There has been an global pandemic of a specific type of crime that has a global affect and has existed for decades if not centuries. Two of it's flavors are "House Hijacking" and "Building Hijacking". Through the centuries it is generally known as "land grabbing".
On "It's My House" we shall discuss the crime of "House Hijacking" and why it is so hard to detect until it too late. The primary reason is that it is a OFF THE GRID CRIME.
Usually there are no police reports, court preceedings, or even court records available on this crime. What makes matter worse is for the most part House Hijacking is not listed as an OFFICAL CRIME !
The combination of being "off the grid" and "not official make is the perfect crime for many predators.

One of the biggest urban legends in real estate is that a house can be legally obtained by claiming "squatters rights" and believing that squatters rights IS adverse possession. (It's NOT).
There is too much mis-information and mis-education on this topic.
First things first "squatting" IS "trespassing". Trespassing according to the government is a (wrong doing) that comes in two flavors:
Civil Trespassing is a civil wrong doing known as a TORT.
Criminal Trespassing is a crime.
Trespassing ...aka......."squatting" is not sanctioned by the government and is OFFICIALLY a crime on the books as well as a civil wrong (on the books) which can result in "Damages" to the "trespasser".
Trespassers.............aka.......squatters........HAVE NO LEGAL RIGHTS as in relationship to ownership.
Although real estate owners can not legally "self evict", what they can do is "legally" go after a "trespasser"........aka........"squatter" in Civil Court, Criminal Court, or BOTH !
Adverse Possession is only a "legal issue" IF there is a TITLE DEFECT !
Adverse Possession has to be one of the most misunderstood legal concepts on the planet. In this installment of "It's My House", hopefully we can make people aware of what the real story is on adverse possession.
We shalll also make homeowners aware of how to turn the tables on a "trespasser"............aka.........."squatter" without filing for an eviction.

Attorney Linda Tirelli (NY)
- is representing a local homeowner in bankruptcy, alleges in court papers that the Wells Fargo manual sets forth “in detail a procedure for processing notes without endorsements and obtaining endorsements and allonges.”
New York Attorney General Eric Schneiderman and three major regulators are investigating allegations made in a federal court case. that Wells Fargo has set up detailed internal procedures to fabricate foreclosure papers on demand.
Attorney Tirelli was also in the headlines last summer with this story:
Bank of America, the second-biggest U.S. lender, rewarded staff with cash bonuses and gift cards for meeting quotas tied to sending distressed homeowners into foreclosure, former employees said in court documents.
Attorney Tirelli, a White Plains, New York-based lawyer who represents clients seeking modifications from Bank of America, included these affidavits in a letter to the NY State Attorney General dated June 13.

March 14, 2012 - Register Thigpen sued MERS, the document processing company Lender Processing Services, and several banks and loan servicers, using as evidence the contents of his register of deeds’ office. Here’s an excerpt from the press release:“Our office uncovered an abundance of falsified, forged, and fraudulently executed mortgage documents,” said Thigpen.
