Software Infringement Vocabulary - The Software Troll Explained

In this exciting epiosde of Vondran Legal Hour we discuss software audit demands that can amount to being labelled a "software troll."  We have Copyright bullies, Patent Trolls, and now we are going to add to the terms Software Troll which will apply whenever a software publisher (ex. Microsoft, Adobe, Autodesk, Siemens, CNC Mastercam, or other software company, or their intellectual property lawfirms exhibit any of the following behaviours which we often see:

1. Oerly aggressive

2.  Demanding you delete software you paid for in good faith

3. Failing to disclose the "informant" and source of the audit

4. Failing to idenity what they (ex. Business Software Alliance, SIIA, Software Compliance Group), believe to be out of compliance (ex. "what is your issue" maybe there is a quick fix)

5.  Demanding ridiculous sums of money to settle a simple case lf "missing receipts" or "using Home Office for business purposes), mainly because BEst Buy didn't inforrm them of the difference, or worse, possibly intentionally installing Personal Software which may be obviously used for business purposes.  Explain this to people, give them a choice.

6.  Charging $5,000 t0 $7,500 "attorney fees" when the opposing counsel has not really even done any work (attorney fees must be reasonable per attorney ethics)

Start treating hard working people with RESPECT and DIGNITY and not like animals.  When these conditions are not being met, the software compant is being a SOFTWARE TROLL.
