Back in the early 1990s, consumers staged a massive revolt that ended in Congress passing a law prohibiting the FDA from banning popular nutrients (as the agency had threatened to do). A loophole in the 1994 law, however, gave the FDA authority to regulate ingredients introduced after October 15, 1994. The FDA now intends to regulate what it calls "new dietary ingredients".
