First Amendment Lawyer California - Anti-SLAPP statute explained

The first amendment is a good thing, it allows people to speak freely on public issues, sports, politics, etc.  But as they say "free speech is not absolute" it has limits.  In this general legal podcast, Attorney Steve Vondran explains the CAL SLAPP law and how it works and how the judges might view the cases brought before them under CCP 425.16 and CCP 425.17 (commercial speech exemption).  The gist of the "anti-SLAPP" motion to allow a person or company named as a defendant in a civil lawsuit to bring a motion when the Plaintiff is bringing the lawsuit wihtout legitimate cause, and for the purpose of chilling free speech.  It's a trick statute so if you are having any legal issues in this area you should have a lawyer review your case.  The two-part test and commercial speech exemption are discussed in this Vondran Legal Hour Podcast.
