January 16, 2011 12:03 AM Bob Blake wrote time LIMA — Two weeks into the new year and already there’s been one jury trial in Allen County Common Pleas Court. A glance at the court docket reveals the prospect that several high-profile cases may come before juries before the year is finished. Those realities and Hollywood’s portrayal of crime and punishment seem to make criminal trials by jury the rule in the criminal justice system. Those in the legal profession, however, say trials are the exception. One way courts, prosecutors and public defenders attempt to manage their cumbersome dockets is through negotiations, better known as plea deals. “Let me tell you up front that I absolutely despise negotiating pleas. Philosophically, I don’t like it at all,” said Allen County Prosecutor Juergen Waldick. “However, given 400 and some cases a year, it is just fiscally and logistically impossible not to resolve cases. I consider it to be just an unavoidable, necessary evil.” Statistics compiled by the Ohio Supreme Court on an annual basis demonstrate just how many felony cases make their way to the state’s common pleas courts every year. In 2009, the courts handled more than 112,000 cases. There was some sort of resolution to more than 88,000 of those. How many cases go to trial?In a purely statistical sense, very few of the felony-level cases that enter Ohio’s judicial system end in any sort of trial. Oliver. Oliver permits warrantless searches under the private search doctrine even when the police who conducted the search didn’t know about the private search. I don’t think the private search doctrine can extend so far, and in this post I hope to explain why I think the decision is wrong. I also want to explain why a different Fourth Amendment rule, the “apparent authority” doctrine, very possibly applies to the facts of this case. The apparent authority doctrine was not litigated in the Oliver case, but it should have been. If I’m right about that, the Oliver decision may have reached a plausible result but did so using a rationale that is quite troubling and likely to cause more problems in the future. I. If a private party conducts a search, and that private party is not somehow an agent of the government, the Fourth Amendment doesn’t apply. In United States v. Jacobsen, 466 U.S. 109 (1984), the Supreme Court held that the private search doctrine lets the government reenact the private search that was conducted so long as it does not “exceed the scope of the private search.” In practice, what usually happens is that the private party comes to the government and tells the officers about the search. The private party and the government then reenact the private search together. If the government needs more evidence beyond the scope of the private search — for example, if the private party searched one box and there are several boxes present — the government can get a warrant to search the property based on the probable cause of what it learned from both (a) the report of the private search and (b) the reeenactment of the private search. Travis McCabe, in relation to the post-Katrina shooting death of Henry Glover, and the subsequent burning of Glover’s remains and obstruction of justice. The jury found former NOPD Officer David Warren guilty of a civil rights violation, resulting in death, for the Sept. 2, 2005, shooting of civilian Henry Glover, as well as use of a firearm during a crime of manslaughter. The jury heard evidence that defendant Warren shot Glover in the back as Glover was running away from him. In a separate charge, the jury found Warren guilty of using a firearm in the commission of a crime of violence. Warren faces a possible life sentence for the civil rights shooting crimes, and up to 15 years imprisonment for the firearms manslaughter. Evidence presented at trial established that Officer Warren, while stationed on a second floor lookout, shot Henry Glover, who was a floor below him and running away. Glover’s brother and a friend flagged down a passing motorist, "Good Samaritan" William Tanner, who put the wounded Glover in his car to try to get medical attention for him. However, when the group of men drove up to a makeshift police station seeking help for Glover, police officers surrounded the men at gunpoint, handcuffed them, and let Henry Glover die in the back seat of the car. McRae then drove off with Tanner’s car, with Glover’s body inside, and burned both the body and the car with traffic flare. The jury convicted current Officer McRae, who was one of the officers at the makeshift station, on two counts of civil rights violations.
