In this case, the Wyoming Supreme Court found a presumption that children be present at juvenile court, and the statute on permanency hearings requires the children be present at the permanency hearing, unless the court makes a determination that they should not be present prior to the hearing. The presenters will provide information related to recent amendments to the Wyoming Rules of Procedure for Juvenile Courts which requires, "a child shall be present at the permanency hearing in abuse and neglect actions unless the court orders prior to the permanency hearing that the child need not be present. If the guardian ad litem or other party believes a child should not be present at the permanency hearing, a motion outlining the reasons for the request for excusal from the hearing shall be filed no less than ten (10) days prior to the permanency hearing..." The Social Security Act includes requirements that define the circumstances under which the title IV-E agency must, in accordance with an approved title IV-E plan, make foster care maintenance payments [§ 472(a)] and mandates a child’s placement in an approved or licensed foster care setting [§ 472 (b) and (c)] that meets the safety requirements. The Wyoming Department of Family Services (DFS) is Wyoming’s IV-E agency. IV-E findings are required in order for DFS to get reimbursement in IV-E cases, but many of the requirements are also included in the Wyoming statutes and are needed to provide for a child's safety, permanency and well-being. Studies revealed that large numbers of Indian children were being separated from their parents, extended families, and communities and placed in non-Indian homes. Through ICWA, Congress established minimum federal standards to be applied in state child custody proceedings. ICWA requires state courts to utilize these federal standards to determine almost all of key issues that must be decided in child custody proceedings–when a child can be removed or parental rights terminated, what constitutes consent to adoption, and placement of the child in both adoption and foster care proceedings. Compliance with these requirements has been uneven across the country and certain provisions have been interpreted differently from one state to another. For that reason, the Department of Interior issued new guidelines clarifying how the Act should be applied and binding regulations have now been issued.
