Strike 3 Holdings, LLC - BitTorrent Litigation Updates - California citizen sued in Florida for "Equity" in "Pure Bill of Discovery." What on earth is this?
Our boutique copyright infringement law firm has seen it all, but now we are seeking something new. Strike 3 Holdings, (a prolific filer of adult ography file-sharing cases, along with Malibu Media), now appears to be filing lawsuits (not in Federal Court as has been done for a long time) but now they are filing cases in "equity" but yet also seeking damages (for a federal court lawsuit that has not been filed). Does this comply with the rules? Why are they trying to avoid federal court? Are they limited in recovery to their representation to the court (judicial estoppel) that the "amount in controversy does not exceed $15,000? We routinely get monetary demands (not equity demands) seeking 20k, 30k or even as much as 50k from Strike 3 Lawyers such as Bandlow Law Firm in Los Angeles. Before you give in, call us to discuss your legal rights. We are not licensed in Florida, but we are able to accept federal copyright infringement cases (which I suspect are to follow, or at least I was told my client would be sued in California following this Bill of Discovery and the ISP turning over their name and address) subject to federal court rules.
DON'T LET THESE GUYS INTIMIDATE YOU. I BELIEVE THERE IS A SERIOUS REASON THEY ARE PURSUING THIS PROCEDURE WHICH THE FLORIDA STATE BAR HAS CALLED "A DINOSAUR?" We have defended hundreds of BitTorrent "john doe" defendants over the years. Call us at (877) 276-5084.
