This week on Perspectives we will be interviewing Simon Kabanda, spokesperson for the Technical Committee on Drafting the Zambian Constitution. This committee was convened by President Sata in November 2011 and was tasked with drafting a new constitution.
The first draft was just released on April 30. The forty-day review and comment period is currently underway. We encourage all our friends and listeners to review the document, and educate themselves on what could likely be our national constitution.
Please come prepared for a vigorous discussion with Mr Kabanda. Among the issues we will discuss with him are a) the next steps in this constitutional review process, b) the likelihood that this committee’s work will be successfully adopted while others have died prematurely, and c) the amount budgeted for this work.
Isaac Mwanza serves as Governance Advisor at the Young African Leaders Initiative (YALI) in Zambia, he was recently in the United States as a Mandela Washington Fellow at the Invitation of US President Obama and studied civic leaders at the Presidential Precinct in Virginia.During the Fellowship, he studied at Jameson Madison's Montpelier Center for the Constitution, Americas premier constitutional training center where he studied on constitutional reform. YALI was until recently part of the Grand Coalition on the people driven constitution in Zambia until they left the organization whose emphasis and position is enacting the constitution through a national referendum. Isaac joins us to discuss YALI's position on the constitution adoption process, is it a logical or even practical for the constitution to be enacted before the 2016 General Elections? What are the options of this being achieved at minimal cost with all stake holders being in agreement? Is the government road map realistic or it is another strategy of delaying tactics? which provisions in the draft constitution are YALI's primary concern which need to be addressed? Join us for another insightful discussion as we reflect on the daunting task of the constitution making process in Zambia and how those in the Diaspora community can contribute to the process.

"The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress; provided that no amendment which may be made prior to the year one thousand eight hundred and eight shall in any manner affect the first and fourth clauses in the ninth section of the first article; and that no state, without its consent, shall be deprived of its equal suffrage in the Senate. " Article Five of the United States Constitution describes the process whereby the Constitution may be altered. Altering the Constitution consists of proposing an amendment or amendments and subsequent ratification..

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”
These 45 words make up the complete First Amendment to the U.S. Constitution. For many of us, they are the most important words ever strung into a complex sentence, because they’re the foundation for the unique American way of life.
Only individually can we and do we, choose not to hate, or not to be ignorant, or not to be racist, no law or legislation can do that, or choose that, for us. It is too great an infringement on our Liberty, to have to be selective of every word that we choose, just so we do not offend anyone. People do not have to listen to people they find offensive, or read what people have written if they find it offensive, or watch entertainment they find offensive, or look at art they find offensive. They have the power and the right to censor for themselves, but not others or society. We need to get back to the place where we once were in this Country. When people were willing to fight and die to give liberty and freedom to everyone, and not just the people they agreed with.
Freedom of Speech is valued by most people as a God given right that are so important, it must be guaranteed by the government. Americans after the Revolutionary War decided they did not want the government restricting their speech. In general, at the time of the writing of the Constitution, the concern about protecting free speech was in regard to protecting political speech.
