Music Publishing Rights?The broad bundle of rights that are associated with a musical copyright are known“music publishing rights.”These rights are not defined by statute but rather are terms recognized in the music industry. Similarly, the concept of the “writer’s share” versus the “publisher’s share” is based in practice, not law. 50% of the income derived from the exploitation of a composition is deemed to constitute the publisher’s share and 50% the writer’s share.Author assigns the copyright in the composition to the publisher, the publisher collects 100% of the income and, after deducting costs, balance for the author.Other typical types of arrangements between authors and music publishers include co-publishing agreements,under which the copyright ownership is shared author (heir) and publisher;administration agreements,under which the author (or heir) retains the copyright ownership and the publisher administers the rights; and co-administration agreements under which the author (or heir) retains the copyright ownership and co-administers the rights with the publisher.The performing rights societies have subscribed to the distinction between writer and publisher shares and allocate monies accordingly, usually paying the writer’s share to the author or his/her heirs.1.Dramatic or “Grand” Rights 2.Non-dramatic or “Small” Performance Rights 3.Synchronization Rights 4.Mechanical Rights 5.Print Rights 6.Concert Rental Rights 7.New Media Rights . Mala Spotted Eagle Pope (website) is a Western Shoshone and Cherokee Native American. He has studied with many different medicine people, spiritual leaders and native elders.
As a young man, he traveled with and assisted his father, Rolling Thunder, on speaking tours, was involved with the original Red Wind foundation, a Native American camp teaching traditional values in Southern, California, and, from 1975 to 1985, he was President of Meta Tantay, a Native American intertribal and interracial non-profit traditional camp in the desert of Nevada.
In addition to running Meta Tantay, his managerial skills included setting up a complete cultural program to enhance the 12 step recovery program, organizing the Native American Support Group to coordinate the resources of local tribes and native organizations and was one of the founders who implemented a telecommunications program called RavenWind Inc. to create financial support for Nanish Shontie and Radio for Peace International. RavenWind donates a percentage of its profits to two non-profits every month.
He sits on and advises many distinguished boards. A speaker and teacher, he participates in conferences throughout the United States and Europe talking with people about the Native way of life and its importance to the Mother Earth at this time.
