Getting an injuction to stop a non-judicial foreclosure sale in Californai is never an easy task. But if you have good grounds and proper technique it can be done. Listen it to the valuable real estate radio podcast where Attorney Steve Vondran discusses the general process and some grounds that could get you the injuction.
Common grounds to get an injunction to stop foreclosure in California:
1. Truth in Lending ("TILA") loan recission cases;
2. Failure to follow statutory requriements (ex. a failure to substitute the trustee or record a notice of default or notice of trustee sale);
3. Foreclosing when a client has a signed written loan modification agreement;
4. Foreclosing when a homeowner is trying to reinstate their mortgage (violation of California Civil Code section 2924);
5. Violation of the California Homeowners Bill of RIghts ("CHBOR") for example foreclosing with:
(a) robosigned foreclosure documents (such as assignment of deed of trust, notice of default or 2923.5 declarations)
(b) evidence of "dual tracking" (ex. foreclosing while considering a property owner for a loan modification after a "completed" loan modification application has been submitted
(c) failing to respond to a CHBOR request to provide "evidence of indebtedness"
6. Foreclosing while promising to extend or postpone the foreclosure sale

During World War II, it was noted that everyone thought God was on their side. Abraham Lincoln said it right, "I trust God is on our side. But it is more important to know that we are on God's side?"
Which side is God's side? This question would have been elementary 100 years ago. Everyone had a good idea of right and wrong. It was right to believe in God. It was right to go to church. It was right not to cuss and swear. It was right to honor our parents. It was right not to steal. It was right not to commit murder. It was right not to Lie. It was not right to covet someone else's property. It was not right to commit adultery.
Today, we wonder what happened to what's right? What changed society's opinion of right and wrong?
If you go to Asia, right and wrong, honor and dishonor are still a huge part of their society. This is why I like to watch Korean Dramas. They are still producing dramas that exemplify morality, right and wrong in families and in the society.
There are two places in our society where it is easier to distinguish who's side we are on - on the battlefield and in the hospital on a sick bed.
Let's not get to that point, but let's make a decision now, to be on God's side.

What is a good neighborhood? Is it about the money? The schools? The crime rate? The helpfulness of neighbors who otherwise mind their business? The low percentage of Blacks and Latinos but the high percentage of white people who are employed? Is it the property tax rate? Can a good neighborhood exist in the city or does a good neighborhood only exist in the suburbs? Do only good people live in good neighborhoods? How far apart do good and bad neighborhoods usually live from each other? Where is the good and bad line that separates the two?
What is a bad neighborhood? Who lives there? Is it the exact opposite of what a good neighborhood is? Does a bad neighborhood only have bad people and things living working in it? Do people who live in a bad neighborhood work? What does a good neighborhood and a bad neighborhood have in common? Do people from bad neighborhoods go to good neighborhoods and if so, for what? Do people from good neighborhoods go to bad neighborhoods and if so, what for?
What is good and bad when it comes to neighborhoods anyway and is there a way to measure it? Do statistics tell the whole story? Do resident testimony tell he whole story? We're gonna use both and see what we can find out about this strange phenomenon that everyone seems to understand so little and so lot about.
Do Blacks and whites live in the same good and bad neighborhoods? Do Black people move from bad Black neighborhoods to better Black neighborhoods or is it that you must move to a neighborhood where there are more whites than Blacks for a neighborhood to be good?
Be sure to tune into this one and bring friends and/or children to listen in. You might find out some good and/or bad things about your good or bad neighborhood.
