    The Marihuana Tax Stamp Act of 1937

    During the Great Depression, massive unemployment increased public resentment and fear of Mexican immigrants, escalating public and governmental concern about the problem of marijuana. This instigated a flurry of research which linked the use of marijuana with violence, crime and other socially deviant behaviors, primarily committed by "racially inferior" or underclass communities. By 1931, 29 states had outlawed marijuana.


    After a lurid national propaganda campaign against the "evil weed," Congress passed the Marijuana Tax Act. The statute effectively criminalized marijuana, restricting possession of the drug to individuals who paid an excise tax for certain authorized medical and industrial uses.

    Tonight- A Michigan man dares to tell news media about the seizure of his property by police without being charged for a crime- gets subsequently arrested at the convenient time of 2 a.m. The man, Wally Kowalski is a medical marijuana patient and caregiver, who had an outdoor garden. And attorney Dan Grow who is representing Mr. Kowalski.


    Also, an amendment to prohibit the DOJ from spending taxpayer money to undermine state medical marijuana laws is included in the 1.1 trillion dollar budget bill being prepared for a vote by the end of this week, or early next week.     Some alleged attorney, who works as a prosecutor in Munsing Michigan, got a little out of control, and bad mouthed the MMMA to a jury during a trial. The Michigan Court of Appeals found her behavior to be in appropriate. We will be addressing this issue, and offering appropriate legal commentary.

    Tonight- Richard Delisi was sentenced to an inhumane 3 consecutive 30 year sentences, a "de-facto" life sentence, for pot because of a technical error- according to International The Human Solution site devoted to the Delisi Project. There will be a long awaited court hearing in Florida next month- If Delisi's lawyer can prove that the error, that resulted in the horribly incorrect sentence, took place in 1989 when he was originally sentenced, he could walk out of the court room a free man.

    Should a member of a household, in which there is a medical garden, be subject to criminal charges associated with the garden, even without having any direct involvement with the growing operation?

    Is the inside of a car private property?


    Can cities locally reduce or remove criminal penalties for adults with small amounts of cannabis?


    Can people, fired for being medical marijuana patients collect unemployment compensation?

    Also Debra Young, assisted in getting a ballot for cannabis legalization in several Oakland County cities, including Hazel Park and Oak Park, which will be decided on Tuesday by voters as well as Berkley, Huntington Woods and Pleasant Ridge, which will be voted on in the general election in November. Debra is also the campaign manager for Andrew Cissell who she worked with on all of the Oakland County local ballot efforts and who is running for state representative in the 27th district.


     


    The masterminds of the local ballot initiative strategy and the founders of the Safer Michigan Coalition- the Godfather Tim Beck and recent recipient of the High Times  lifetime achievement award, and the man whose name consists of two verbs- Chuck Ream, will also be calling in to go over the status and line-up of the local ballot efforts around Michigan.

    Regular cast member and attorney Jeff Frazier who years ago worked on the infamous Tulia case in Texas in which one of every three black members of the community were arrested and jailed by a multi-jurisdictional task force. Jeff worked with the ACLU and others to get the people out of jail and to disband the task forces around the state. He will discuss the recent appointment of Vanita Gupta to head the civil rights division of the Department of Justice and the role she played in helping to correct the injustice in Tulia, Texas, and describe what he has learned about the task forces in Michigan, and what actions may possibly be taken, as a result. Jeff has been working with Komorn Law and Michigan Moms United on these issues.


     


    And, Hunter Holliman Chief of Staff for the national organization Americans for Safe Access, the country’s leading medical cannabis organization. Hunter will discuss ASA's perspective on upcoming elections, and the purpose of the web site votemedicalmarijuana.org ASA, also, recently posted information from the California Narcotic Officers Association to help demonstrate and expose "more unsavory ways police attempt to discredit and imprison qualified medical cannabis patients."
