Home Front with Mark Kiser- The Doctrine of the Lesser Magistrate

    in Politics Conservative

Are you tired of watching the courts make up new laws?  Is there anything the elected officials can do when the unelected bureaucrats twist the constitution into a mangled mess ?
Today we talk with Mark Kiser about a concept and some new vocabulary words: The doctrine of the lesser-magistrate.

What is the right response to a bad law?  Whose job is it to oppose injustice?  What should the elected officials do when faced with a conflict between the Constitution and a misguided bureaucrat?  Accountability is critical, but who creates that accountability?

Mark Kiser is the President of Reclaiming Missouri for Christ. http://www.missouriforchrist.org/   He shares with us his insights on what it's going to take to be a conscience for our culture.   Join us for a history lesson and some fresh hope.

Reentry Court: One Community's Model to Help Youth Returning Home

    in Legal

After spending time in a correctional facility, youth are often released without family, system, or community support.  For a myriad of reasons, these youth face high rates of unemployment and education failure, have limited viable housing options, and are unable to access the assistance they require. Many now realize that in order to achieve long-term success, that reentry planning must occur way before a youth returns to his or her community. In order to address this disconnect and increase chances of success, the Juvenile Court in Cuyahoga County, Ohio, in partnership with the Ohio Department of Youth Services, Division of Parole, and community-based services, created a reentry court. Using evidence-based practices and with a goal to reduce recidivism and re-incarceration of youth, the project begins to work with youth several months before release and the support continues post-release. Guests on this episode will discuss the development and implementation of the collaborative effort, provide an overview of the mechanics of the reentry court itself, and share lessons learned.

    Guests:

Karl M. Cetina, MPA, LICDC-CS, Director of Juvenile TASC for Cuyahoga County Catholic Charities, Diocese of Cleveland

Ian Fraser, Cleveland Regional Parole Administrator, Ohio Department of Youth Services

Magistrate Terease Neff, Cuyahoga County Court of Common Pleas, Juvenile Division

WHAT WAS THE JUDGE THINKING? THE JUDICIAL SIDE TO FAMILY COURT DECISIONS

    in Current Events

You’ve heard it - “My wife is crazy, but the courts are so prejudiced against men, she got full custody.” “He was abusing me in front of the children, but the judge didn’t even pay attention to me- he got full custody.”  “We have shared custody – how can I ever get him/her to be reasonable when it comes to the decisions about the kids?”

Oh, the horror stories we hear.  It seems like men’s groups and women’s groups are becoming more active about the sad state our family courts are in.  Anyone who’s been in front of a judge knows the fear, the devastation and the lifelong impact of their decisions regarding divorce and child custody.  It seems like everyone is let asking, “What was that judge thinking?”

Now is your chance to find out.  Join us Saturday to hear A Colorado family court judge explain how judges think, assess, and make decisions, and what laws they have to consider when making those decisions.

Angela R. Arkin has been a District Court Judge in the 18th Judicial District since 2002. She’s a graduate of Emory Law School, and is licensed in Colorado, Georgia and the District of Columbia. She began her judicial career by serving two years as a District Court Magistrate in Arapahoe County with a domestic and juvenile docket. She is currently handling a 100% domestic docket in Douglas County. Prior to her current assignment, Judge Arkin has served as a District Judge in all four counties in the District, with mixed dockets including criminal, civil, probate, mental health, juvenile and domestic cases.

Indiana: Probate is handling child custody?

    in Politics

Join us this evening as Mary Harper joins us from Indiana's St. Joeseph County.  The question we all should be asking is:  How did a child custody case end up in a probate court?  Who died?

My name is Mary. I live in South Bend Indiana which would be St. Joseph County jurisdiction. I am a Mother, a USAF reservist and a college student. I am of sound character reaching out to acknowledge there is a legitimate problem with the practices of law in this St. Joseph Probate System.

I have been put through the ringer fighting for my youngest Daughter Ella, who was taken from me 4 years ago...on my birthday. The Father to Ella...and his corrupt attorney went into the court room of Magistrate Barbara Johnston at the local probate court...accusing me of everything a person could accuse another of, and was granted an emergency petition to take my baby. There was never any evidence produced or showing that any of the charges levied against me were true.

Four years out and a journey of false accusations...mind you I proved wrong, and lengthy continuences...with no evidence from opposing counsel, a magistrate that felt that "order of the court" meant her order and not the law, I am still without my child. I have no criminal record, while my child is with a guy that has had a felony charge and just recently, another battery charge. I have been robbed my of rights...but most of all my child has been ignored by this ungoverned and improperly instructed, supposedly overwhelmed probate system and denied her Momma that Loves her dearly and I might add her two sisters whom I raise on my own, that miss her so.

This biased and unethical magistrate denied me my request for the local agency in this county to come in and see what would have and should have been for the "best interest of the child." My little girl has been put on a roller coaster and I need my baby.
