    The Montana Republic: Trial By Jury & Jury Nullification

    US Constitution,  Article III Section 2 Clause 3:
    "The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed;..."
    In today's courts, judges think they are the final word on juries. They are not.

    JUDICIAL TYRANNY AND JURY NULLIFICATION

    jury Nullification or by another name “The Fully Informed Jury" is one of the greatest controls on tyranny available to us.


    Jury nullification has a long history in the United States. Our forefathers referenced it as a remedy to judicial tyranny and bad law. It is time we excercised that right again.


    Joining us is Dr. Rodger Roots.


    Dr. Roots is a nationally recognized criminologist, legal scholar and civil liberties activist.  He is active in libertarian politics, and in the promotion of a freer, fairer and more just world.  He is the author of more than two dozen noteworthy scholarly articles, and some of his research has been relied on by federal courts.   He is an advocate for the rights of the disenfranchised, the downtrodden and the politically estranged.


    His work and advocacy on three areas: the fully informed jury movement, the reestablishment of Fourth Amendment protections and the establishment of a fair and equal court system for all participants.


    Dr.Roots has published an important article on the lopsided procedural rules of the federal court system, “Unfair Rules of Procedure: Why Does the Government Get More Time?,” which appeared in The American Journal of Trial Advocacy in 2010.


    He is a Founding Member of the Wall of Tolerance, co-founded by Rosa Parks, whose courageous stand against authoritarian government in 1955 showed millions of others how to resist government by simply saying no.

    Join me for a Cultural Conversation with Harold Michael Harvey, author of the new book, Justice in the Round. Harvey will give his perspective on the country’s racial dynamics at play in the American Jury System.


    Harvey is the author of the critically acclaimed legal thriller, Paper Puzzle and author or a new book, Justice in the Round. Harvey formed the Cascade Publishing House to publish his works and the works of other authors who feel more comfortable in a small publishing house.


    Harold Michael Harvey is an American award winning journalist, former lawyer, political pundit, novelist, essayist and publisher. He earned a degree in Political Science from Tuskegee Institute and a Juris Doctorate degree from Atlanta Law School. Harvey was honored for “Outstanding Work in Newspaper Journalism,” in 1976 by the National Newspaper Publishers Association. The Gate City Bar Association bestowed upon him their prestigious R. E. Thomas Civil Rights Award in 1996 after Harvey represented over 180 college students arrested in the City of Atlanta during a black college spring break ritual known as “Freaknic.”

    DA INVESTIGATOR JACOBSON TO ANSWER FOR JURY TAMPERING

    DA investigator Steve Jacobson has been charged with contempt based on his conduct in connection with the people versus audio Pontillo.


    Jacobson is accused of tampering with the jury in a declaration by judge Scott Steffen in the case of the PEOPLE v. ALEO JOHN PONTILLO.


    Jacobson has been notified that contempt proceedings are criminal in nature. If the court finds you in contempt the possible penalties include jail sentence, community service and fine.


    The court date is May 15, 2015.

    Voices of the Cannabis War Episode 4

    Voices of the Cannabis War showcase the voices of the victims in the cannabis war!  We show the trauma going on with those and those possess, sell or cultivate it . This week's theme is women in prison!  You will hear from Stephanie Landa, Amy Pova, and Andrea Harps about their time in prison!  You don't want to miss what these amazing women have to say!  You will also hear from Craig Cesal who is serving a life sentence and possibly Jason Nelson, a federal plant prisoner from Oregon! Our plant prisoners earn less than 20cents an hour, often moved away from their families, and forced to live with murders and thieves.  Over 50 are serving life sentences and have been in since the 80's.  This show is an effort to remind the world of their sacrifices.  Voices of Cannabis War is hosted by Eugene Fischer and Kristin Flor.  It is presented to you by volunteers.  Regular guests include Craig Cesal (serving life in prison), Stephanie Landa, Mindi Griffiths, Miggy 420 and many more!


     

  • "The Wealth of Forgiving Yourself"

    Are you to heard to hear on yourself?  Why is learning to forgive ourselves so much harder than forgiving others?  We all mess up, and sometimes in really big ways!  The list of portential misdeeds is very long!  Did you lie, did you cheat in some way, hurt someone, judge someone, or just "not do what you were supposed to do?"  This tendency to withhold forgiveness produces sickness and disease to our soul and body.  So many people have a constand, critical voice in their head that criticizes everything they do, every move they make.  Forgiving yourself doesn't mean not being angry at yourself, nor does it mean that everything is ok, or that you have minimized or justified the offense.  It simply means liveing at peace with yourself, and resisting the desire to be your own "prosecuting attorney, judge, jury, and executioner"!  The wealth we receive from living out these rules of forgiviness brings life, ushers in hope, and gives the on going restoration we need for our bodies and souls.  Joine me today as  we learn these three basic rules to living a live of honesty, hope, and health.
