    WHERE ARE THE JUDGES ON JURY TAMPERING?

    Judge Scott Steffen bails on DA jury tampering


    According to jurors in the A.J. bail bonds case, Dist. Atty. Dave Harris and DA investigator Steve Jacobson interviewed them outside the courtroom before they went into deliberations.


    Judge Scott Steffen stated that he was obligated to do something about the corruption of his jury but was seeking “legal advice” on what should be done.


    On Friday, February 27, a hearing was scheduled to hear the complaint against the Dist. Atty. and what course of action had been decided by Steffen.


    Dist. Atty. Dave Harris was represented by County Counsel, but the judge had already decided that he was removing himself from the case.


    Steffen sent the case to Judge Silviera, who then sent the case to Judge McFadden.


    Back room decisions have been made. Perhaps the legal advice that was being sought by Judge Steffen was to remove  himself  from the case. Who is advising the other judges on what to do about the misconduct in the District Attorney’s Office.


    All this was done without any paperwork and leaves the judicial system with an obligation to inform attorney Frank Carson about what is going to be done about his revelation of the jury tampering .


    At the very least,  Judge Steffen should reveal what legal advice he has received other than he might be a witness.


    Judge Steffens jury had not been released to go into deliberations when jury members reported to the court bailiff the actions of the District Attorney’s Office and in particular those of investigator Steve Jacobson.


    Nine days after the jury’s decision to completely exonerate AJ Pontillo the courtroom bailiff  was fired by Sheriff Adam Christianson, she had served the County for 16 years.


    Christianson was a witness at the trial, On the way out he paused and saluted the bailiff that he fired after the trial.

    Right to a Jury Trial in Wyoming Child Protection and Termination of Parental Rights Cases


    Cindi Wood, J.D., C.W.L.S., an attorney in private practice in Casper, Kevin David Taheri, J.D. an Assistant District Attorney, Seventh Judicial District Attorney’s Office, and Christina McCabe, J.D., a Senior Assistant Attorney General in the Wyoming Attorney General’s Office, Human Services Division will present an overview of the law relating to the parent’s right to demand a jury trial at the adjudication stage of a child abuse/neglect case and at a termination of parental rights case. They will talk about the law governing jury trials including the statues and rules including time and filing requirements. They will refer to the work being done on the Wyoming Juvenile Pattern Jury Instructions and the many procedural issues one needs to address when there is a jury trial. The audience will learn about the distinction between a bench and jury trial, factors to be considered when determining whether to demand a jury trial for their client and tips from judges.

    During her campaign for re-election DA Birgit Fladager said, “Frank Carson defended Mayor Sabatino.”


    Frank Carson was not elected, but Fladagers office failed to convict Mayor Sabatino, despite an out-of-town judge and almost $1 million in resources from the taxpayers. Frank Carson had an advantage he dealt with the truth.


    Sheriff Adam Christianson led an eight year investigation of AJ bail bonds followed by a five-month trial in which AJ Pontillo was exonerated and DA Dave Harris was exposed for his utter incompetence. One juror said, “The DA thought we were stupid.”  Frank Carson had an advantage he dealt with the truth.


    Frank Carson defended whistleblower Frank Drummond, who was accused of sexual abuse. The jury voted 11 to 1 for acquittal. The jury foreman was disappointed that they could not deliver a unanimous vote. Frank Carson had an advantage he dealt with the truth.


    When DA Beth De Jung announced that the DA would not retry case, she engaged in further character assassination to explain why she lost.


    These DA’s lost their “victories” because they did not seek justice.

    Life Without Parole-Kevin Upkins Story

    Ripped out of the headlines Jury Finds Suspect Guilty Of Armed Robbery.


    Douglas County District Attorney David McDade announced today that his office successfully prosecuted Kevin Upkins, a 29 year old Fulton County man, after a jury found him guilty of armed robbery this week.  The charges stemmed from a May 2, 2008 incident at Security Finance on Fairburn Road.


    According to evidence presented at trial by Assistant District Attorney Jeff Gore, Upkins robbed Security Finance of approximately $3,000 after ordering a female employee to the floor at gunpoint.  When Upkins grabbed the cash out of a drawer in the business, he also picked up several checks that had been placed on top of the larger bills.


    Within minutes of the robbery, Sergeant Todd Garner of the Douglasville Police Department responded to the scene and recovered three checks that Upkins had dropped on the floor of the business.  Upkins was later identified through his fingerprints located on two of these checks.  His fingerprints were on file from previous felony arrests in Atlanta, But is that what really happen?
