Late Monday night, U.S. District Judge Andrew Hanen of Texas issued an injunction preventing USCIS (U.S. Citizenship and Immigration Service) from accepting “expanded” DACA (Deferred Action for Childhood Arrivals) applications. The expanded DACA eligibility criteria was scheduled to take affect today. Those who meet the original 2012 DACA criteria are still eligible to apply Those that already have DACA are also able to apply for renewal. The injunction also prevents the USCIS from accepting of DAPA (Deferred Action for Parental Responsibility) applications.
In the meantime, the general advice to those who qualify under expanded DACA or DAPA is to continue information and document gathering and seek local counsel- beware of “notarios” or “immigration consultants” who are not authorized to give legal advice.

Barbara Stone is a courageous "David" of sorts, taking on Goliath in a federal lawsuit against the Florida Bar for racketeering. She has also sued several judges for the legal abuse she has suffered via going to jail and being placed on house arrest for daring to try to save her mother's life from guardianship. In return for filing the most recent lawsuit, the judge in her mother's guardianship, Michael Genden, has issued a "show cause" order as to why she should not be held in contempt of court. The Order lists violating his Order, which prohibits Barbara from having any indirect or direct contact (ie knowing about her mother's neglect by the guardians), but is completely based upon hearsay and is thus, "no evidence." It certainly is replete with hearsay, which will not support a show cause order. The Judge is further trying to hold her in contempt for filing the Motion to Disqualify him due to his adverse interests. What a mess! Florida statutes say the Judge should disqualify himself because the 14th Amendment due process mandates it. See Caperton vs. Massey United States Supreme Court opinion (2009), which states that a judge must disqualify himself if there could be even an appearance of bias or impropriety, whether or not it subjectively exists. I think we have definitely met that standard here. The media will be at Monday's hearing, so let's cheer and encourage Barbara on as she helps write history!
