Many elderly adults are abused in their own homes, in relatives’ homes, and even in facilities responsible for their care. If you suspect that an elderly person is at risk from a neglectful or overwhelmed caregiver, or being preyed upon financially, it’s important to speak up. While the majority of abuse occurs at the hands of professional predators in the system, there is always the spectre of abuse and financial exploitation at the hands of a family member or friend. When it does, it is the wedge used by professionals to insert themselves into the estate.
We will be talking about how and why this occurs and how to recognize early signs of the exploitation that may be just beginning.

One in 10 older Americans experience abuse each year.
This number increases to 1 in 2 when the person has dementia.
Elder abuse occurs in both homes and facilities and occurs in many forms including financial, sexual, physical and psychological abuse as well as neglect

As our loved ones age, many factors such as physical illness, diminishing mental capacity, and dementia can make them vulnerable to neglect, abuse, and exploitation by caregivers, family members, or others. There are a number of Illinois laws and mechanisms in place to prevent and respond to these types of elder abuse. In this podcast with Heather Walser of Lavelle Law, we will explore: (1) the options available to help prevent these types of elder abuse, and (2) the steps you should take if you suspect that a friend or loved one has been the victim of elder abuse.
As the demographics in the U.S. continue to increase in numbers of the elderly, the potential for Elder Abuse increases as well even though crime statistics tend to reflect older adults are unliekly to become victims of violent crime. The highest percentage of crime against persons 65 yuears of age or older is property crime. Thefts against older adults are about 1:5 crimes committed as compared to 1:33 for people aged 12 to 49. Growing old is sometimes hallmarked by greater vulnerability and we do not have reliable statistics on crimes against older adults that go back very far. This show will highlight crimes against the elder.y and include information on defining Elder Abuse, explaining adult protective services, addressing the categories of abuse most commonly found, and relate all of these to Family Abuse as well as Institutional Abuse.

According to the National Center on Elder Abuse Bureau of Justice Statistics, in 2010 there were over 500,000 elder abuse cases in the U.S. alone. Understanding the issues related to elder abuse has become even more important as the elderly population of the country continues to grow. Danielle Jesser attended Appalachian State University majoring in Pre-law and English. Shortly after working for an attorney in North Carolina she began working as an elder abuse advocate where she realized that edler abuse is rampant. Danielle now works with the Senior Veterans Council (Raleigh, N.C.), the National ADA Advocates (main office, N.Y.), and in her free time volunteers with NASGA (National Association to Stop Guardianship Abuse), local Senior Centers, and other families that contact her for assistance. Her goal is to help raise awareness, find justice for victims, educate the public, and fight to change legislation in order to better protect people from this type of abuse.

Today is Elder Abuse Awareness Day. Obama announced he was making that official. I can only imagine the media spins that are being constructed right now to cement in the public mind that it is only family and friends who abuse, neglect and exploit the elderly.
We know better. We know family and friends account for only 4-5 % of the abuse of the elderly. The remainder is at the hands of professionals who game the system in order to loot the estate. But mainstream media won't even mention that!
Tonights show will highlight many of the cases of professional predators operating within corrupt probate courts across the country that have stolen billions from the elderly while holding them prisoner in what usually turns out to be a sub-standard facility. Forced medication, anyone?

This is a show about financial elder abuse. As the elderly population continues to grow, and the economy remains tight, some people see senior citizens and elder folks in their 70's, 80's, 90s and even in the 100'3 as their quick ticket to easy street. These are financial predators that must be stopped. Possible predators include:
The ruthless relative (ex. children) The slimy salesperson (ex. car salesman, insurance salesman, investment advisor, the stock broker) The predatory professional (ex. accountants, CPA's, attorneys, lawyers, financial planners) The conniving caretaker (ex. nurse) Others in a close position of trust or fiduciary relationship (ex. a trustee) This is not even to mention all of the online scams directed toward the elderly which Attorney Steve will mention a few.

What you learn could help you protect your loved ones from some of the financial abuses, online scams and identity theft schemes that target your loved ones.
Where elder abuse can be shown, you may be entitled to damages, costs, attorney fees, compensation for personal injury or wrongful death, punitive damages, restitution, and other available remedies.
The law is also interesting as it allows pre-judgement writ of attachment of Defendant's real property and certain other non-exepmt assets. This is potentially a very powerful provisional remedy.

Elder abuse: The Crown of Life Society turns fact into compelling fiction
William Henry and A. Frank Johns, Jr. wrote their novel, The Crown of Life Society to expose a broad range of issues involving family caregiving and elder exploitation. Their goal has been to provide helpful information, through an exciting story with vivid characters...families and predatory villains alike.
William R. Henry, Jr. has been a professional writer more than 40 years. He became interested in the subject of elder exploitation and the dynamics of caregiving following an incident in his own family. He wrote about that incident for The Washington Post, and began the research that developed into The Crown of Life Society, the first novel ever to address elder abuse as its primary subject.
Co-author, A. Frank Johns, Jr. is a nationally recognized legal authority on elder law, guardianship, disability rights and related issues. He is past president of the National Academy of Elder Law Attorneys and charter chair of the North Carolina Bar Association Elder Law Section. He is a charter partner in Booth Harrington & Johns of NC PLLC, with offices in Charlotte and Greensboro, NC.
