CEMEX SAB de CV (ADR) NYSE:CX "MM") Shareholder Derivative Action?: Part1

    in Legal

Will CEMEX ("ADR" CX:US" CLH" CEMEXCPO:MM) (BVC: CLH) and CEMEX SAB de CV (CEMEX USA) shareholders file a derivative class action lawsuit in 2015? It appears that the shareholders may have a viable claim against CEMEX based on fraud, illegal activities, or gross mismanagement by CEMEX because the Board of Directors has failed to address corporate abuse and criminal acts committed by their employees, agents and affiliates. CEMEX has failed to police its own employees to the detriment of productivity and outcome and therefore, a decline in stock value.

Has the negligent behavior exhibited by CEMEX staff, employees and agents resolved in poor cement quality; that the lack of proper handling and use concerning the production of cement is the reason for defective housing structure, buildings and infrastructure throughout this country and abroad. Has these acts resulted in misappropriation of corporate assets, has there been a wrongful delegation of corporate duties and a failure to address the negligent acts of employees, and is the negligent acts committed by employees deemed a breach of corporate duty of care, duty of loyalty and has resolved in a a waste of corporate assets to cover their wrongdoings. This is particularly true, where these acts are the result of nepotism.

Therefore, it is important to do an extensive background investigation into the company and companies responsible for manufacturing, producing and distributing cement because poor quality cement resolves in billions of dollars in losses to businesses, insurance companies and consumers. For such reasons, CEMEX shareholders may consider litigating against the corporation in 2015.

Jaime Gerardo Elizondo Chapa Board Member President and Karl Watson are called upon to take immediate action.

Tips on following up with new people you meet at social and networking events

    in Legal

Episode 44 of Building Your Law Practice with Jim Thompson and Nick Augustine

Let’s get back to the basics of social and business interactions and focus on following up with people we want to know, like and build trust. Too often people act like robots by going to events, giving a canned speech about themselves to another person, giving away their business cards and asking for others. Many bring the collection of new business cards back to simply set them on a pile and leave them to collect dust. Break the cycle and get to really know them.

Updating and managing your content to optimize your website and earn new clients

    in Legal

Episode 43 of Building Your Law Practice with Jim Thompson and Nick Augustine

Take a look at your copyright notice on your website. If none of the copy has changed, thus requiring a copyright update, ask yourself why. While sections of your website best known by the search engines should not be changed, there are other areas where you might have added new services or changed the way you describe a product or service. Content plans should include frequent blog publishing and tools to share your content, such as boosted content and video.

    Growing your Referral Partner Network

    in Legal

Episode 42 of Building Your Law Practice with Jim Thompson and Nick Augustine

Referrals are the best source of business for many lawyers. When someone we know, like and trust gives out our name to an individual looking for our services, and there is already an endorsement, we are more likely to earn business from the prospective client. Referrals can come from current and past clients, but also from people in what we call the Referral Partner Network. Today we talk about setting up reciprocal relationships with client referral partners.

My Tribute to Andrae' Crouch; By His Friends & Former FB Admin, Dave Nassaney

    in Christianity

Listen TODAY to speak with Dave Nassaney, former Facebook Administrator to Andrae' Crouch (currently at 81,000 followers) and Andrae's closest friends, to share funny "Andrae' stories" and the good times we all had with him celebrating his zest for life. Podcast now available 24 days/hours/day, 7 days/week. Those who knew him well are missing his beautiful spirit already, and his huge fan base will definitely be missing his timeless new anointed songs and arrangements!

For those of you who had not heard, Andrae' Crouch, The God Father of Contemporary Gospel Music, died at age 72 from complications from Saturday's heart attack. Andrae' was an innovator, a path-finder, a precursor in an industry noted for its conservative, often derivative approach to popular music. He combined gospel and rock, flavored it with jazz and calypso as the mood struck him and the song called for it, and is even one of the founders of what is now called “praise and worship” music. He took risks with his art and was very, very funky when he wanted to be.

When Michael Jackson or Madonna or Quincy Jones needed a gospel song or a gospel chorus, they called Andrae. That’s his music on the soundtrack to The Color Purple (where he earned an Oscar nomination), the Broadway musical The Lion King, and the pop songs “Man in the Middle” and “Like a Prayer.”

His first gospel group included Billy Preston, Elvis recorded one of his songs. Podcast available Jan.14

Spiritual Fruit and Manifestations: Walking in the Spirit

    in Spirituality

    Galatians 5:22-26 (NKJ)

22 But the fruit of the Spirit is love, joy, peace, longsuffering, kindness, goodness, faithfulness, 23 gentleness, and self-control. Against such there is no law. 24 And those who are Christ's have crucified the flesh with its passions and desires. 25 If we live in the Spirit, let us also walk in the Spirit. 26 Let us not become conceited, provoking one another, envying one another.

stoy-kheh'-o—from a derivative of steicho (to range in regular line); to march in (military) rank (keep step), i.e. (figurative) to conform to virtue and piety :- walk (orderly).

It literally means to walk in line with; it is not the same as the word used for physical walking in (Gal 5:16). To walk in the Spirit is to walk along the path that He lays down

The person who is led by the Spirit will do what is right freely, not by a sign in the road; by set of rules or by compulsion from the law.

Walking in the Spirit is a sign of maturity understanding our purpose!

SOPHIA STEWART: THE MOTHER OF THE MATRIX AND TERMINATOR MOVIE TRILOGIES

    in Spirituality

If you’re not familiar with Ms. Stewart, she is the author of “The 3rd Eye”, the original source material and basis for the Matrix and Terminator franchises.   Ms. Stewart has registered her work with the  US Patent and Trademark office, and they validate she is the sole, legal owner of all IP, trademarks, copyrights, movies, DVDs, merchandise, and all other derivative products and services connected to both franchises.

Her work was stolen by Warner Bros and Fox, and she was never compensated nor credited for her creative, protected expressions. Instead of compensating her, Warner Bros and Fox paid a team of attorneys to “represent” her, and they intentionally sabotaged her original copyright infringement case in California.

When she found out in 2007 that Jonathon Lubell, the lead attorney that was supposed to “represent” her had been disbarred and convicted of stealing money from a client, she initiated a lawsuit in Salt Lake City where she lived at the time.

Ms. Stewart has since waged a 7 year battle in the US District Court in Salt Lake City alleging fraud, negligence, civil rights violations, due process violations, and a host of other civil and criminal violations. The named defendants include Jonathon Lubell and 3 other attorneys. However, Warner Bros and Fox are ultimately liable, as they paid for the defendants to sabotage her case.   In addition to paying off the defendants, Warner Bros and Fox paid off other law enforcement and regulatory agency personnel, US Patent and Trademark lawyers and examiners, court clerks, various other attorneys, and other co-conspirators,  through a multi-million dollar slush fund.
