Jacob is a Senior Editor of REASON magazine. The July 2011 issue is a SPECIAL ISSUE on CRIMINAL INJUSTICE: Inside America’s national disgrace. Jacob wrote three of the pieces of this quite impressive issue and was co-editor with Radley Balko. I wrote to the editor about having someone discuss the issue with me and he suggested Jacob. He felt he had some of the strongest articles.My interest has several aspects. I was a Probation Counselor and then a Deputy Probation Officer in Watts and Santa Monica during the summers. I’ve spent my life in K-university classrooms and was the one who dealt with the “problem kids.” I saw and experienced how our educational system contributes to the injustices we live with - usually complaining, but too frightened to fight. I tried to live by the Constitution and mutual respect, but seldom saw due process or any of our Bill of Rights offered to ANYONE, staff or students. There is a positive correlation between what happens in our schools (and cultural beliefs) and our horrendous criminal INjustice system. Jeremy "Bam" McDole was paralyzed and injured. The police who were called to help him shot him dead, right out of his wheelchair, on video for all to see. Terrell Day, 18, was suspected of shoplifting. He complained that he couldn't breathe. They ignored him repeatedly, until it was too late. He died. David Stojcevski was oulled over for a traffic ticket. Died in custody after 17 days in jail, without medical care, and after losing more than 50 pounds. In Fairfax County, VA, a black man is instructed to get out of the car and put his hands on the car. He complies. The video shows the officer tasers him regardless. Between October 30 and November 2,2015, the United States will release 6,000 federal prisoners in accordance to new guidelines that went into effect November 2014 when an independent federal commission proposed shorter sentences for drug offenders. The result of the commission's decision that -just because someone was sentenced to a long prison term during the peak of the tough-on-crime era, he shouldn't automatically have to serve more time than he'd get if he were sentenced today. Of the 6000 to be released, only 4,000 are US citizens; about 2,000 of the prisoners scheduled for release are unauthorized immigrants, who will be detained and deported immediately after they're released from federal prison and legal immigrants
In January 2014, the Commission indicated it would reduce the drug sentencing guidelines and in March 2014, the Attorney General supported new guidelines being applied to on-going drug cases. As many as 46,000 prisoners are eligible to apply for shorter sentences under the change.
In 2011, Congress reduced the sentencing disparity between "crack" and powder cocaine and the Sentencing Commission decided to allow current prisoners sentenced for crack cocaine to apply for shorter sentences. The United States incarcerates more people than any other country in the world. Ten thousand people are released from prison every week, most of them from state prisoners. Typically, the federal government releases 55,000 prisoners a year. It will be interesting to see how the federal criminal justice system will help ex-inmates reenter society.
