This episode, Part 1 of a 2 part episode, addresses the topic of, "I have been sued....by my credit card company, what do I do?!”
First, have you actually been sued? Or, have you been threatened to be sued in the future? A letter (even one from a law firm representing a credit card lender) is not a lawsuit. We address some of the basics of what a lawsuit is (filing court documents with court clerk) versus what it is not (phone calls, letters, threats to file a lawsuit in the future if the credit card balance is not paid).
Secondly, we discuss what the general steps are available to you once a lawsuit has been filed against you (service of the lawsuit, number of days to file an answer, notice of hearings, default judgment, appearing at hearings, etc.).
Knowledge is the key to successfully handling these types of situations!
