Small claims court has many different rules and procedures than other courts. It has many more of the elements “as seen on tv,” as very little is documents or correspondence is exchanged between attorneys, or the plaintiff and defendant. Usually attorneys are retained on a flat fee basis, and work is not performed hourly. Discovery rarely happens because the court wants to keep everything moving. A defendant does not even need to file an answer or disclose witnesses in small claims court. If a defendant chooses not to file an answer, the court will assume all allegations are denied. You are allowed to file additional pleadings, such as a counterclaim, but must ask the court for leave to file it. Many surprises can happen the day of trial, since both sides are uncertain as to who will be called as a witness and what evidence will be presented. Both parties will see all documents each side will offer up for the first time at trial. All rules of evidence do apply in small claims court, but in order to enhance efficiency, the court and counsel are usually more relaxed on objections when a witness is testifying or when a document is being requested to be admitted into evidence. Although small claims court is in the same court as all other litigation, it truly has its own policies and procedures.
Assistant State Attorney Gino Feliciani for Circuit Court Judge Group 37
Gino Feliciani has been an attorney for 23 years and has been serving the State of Florida for 22 of those years. In 1991 he began his career at the Office of the Public Defender for the 18th Circuit of Florida in Sanford. While at the Public Defender’s Office Gino tried nearly 100 cases ranging from misdemeanor offenses to serious felony offenses.
In 1997 Gino was recruited by the State Attorney’s Office in Seminole County to prosecute Sex crimes and Child Abuse Cases. Gino has also served as County Court Division Chief, Felony Division Chief and is presently the Sex Crime and Child Abuse Division Chief, a position he has held since 2008. Gino has tried nearly 100 cases as a prosecutor and between 2005 and 2009 tried 10 First Degree Murder cases. Gino is a member of the Multi-Disciplinary Task Team for the Kid’s House of Seminole and has served for the past seven years. Gino was also an active board member of the Sexual Assault Victim Services for Seminole and Brevard Counties from 2010 to 2014.

Shawn C. Marsh, Ph.D., is the Chief Program Officer over Juvenile Law at the National Council of Juvenile and Family Court Judges headquartered at the University of Nevada - Reno. He’s a researcher and teacher and he knows why family courts need to change and how to make that happen. He knows about psychology and the law, adolescent development, resiliency, and juvenile justice.
