Loan Modification Negligence
When you are trying to fight for your home in the loss mitigation loan modification process, it is no laughing matter. You are submitting the documents being requested and hoping you will not be "dual tracked" by your loan servicer who is usually servicing your loan on behalf of an often unkown securitized loan trustee, and you wonder if you will get a fair shake, or a real opportunity to save your home. This real estate podcast talks about what happens when your loan servicer is negligent in handling or reviewing your completed loan modification application.
One of the legal cases every homeowner should have in their foreclosure prevention toolbox is the case of Alvarez v. BAC Home Loans, LP (Bank of America). Some of the common things that can go wrong when you submit your financial documents to be consdiered for a loan mod are:
1. False statements by the loan servicer's representative
2. Claiming your documents were never received ("missing tax returns" and "rental agreements" are two common ones)
3. Denying you based upon consideration of false information (ex. your income or property value)
4. Lies about postponing your foreclosure sale
There are other types of things that can wrong in the loss mitigation department of large loan servicers such as Nationstar, Ocwen, Wells Fargo, Citimortage, and Bank of America, but this Alvarez case is a very important case that discussed "duty" and "damages" in regard to the tort of negligence against a loan servicer. Ezra and Wanda have been dating for 6 months and both are career minded and focused. Ezra was an Assistant Director at a Juvenile Detention Home while Wanda was a Social Worker at a Nursing Home. Despite their demanding jobs both had their passions. Ezra was working on developing a Urban Tee Shirt Business, Wanda was one of the best jewelry makers around, due to their demanding jobs and their other businesses they barely had time to see each other on a consistent basis but when they spoke on the phone, Wanda dominated the entire conversation, if they set aside a hour to catch up on what's been going on in each others life, Wanda would dominate, but her input would be negative, complaints about her job, family, jewelry business, and ex husband. Eventually Ezra grew tired of listening to this same old song over and over. He was looking for balance. Someone he could share his world with and that was not happening with Wanda. When he wanted her to talk between the sheets she was typically quiet, go figure!!!. Eventually they had a massive blow up when Ezra had enough and told Wanda she talks too damn much and he did not want to hear another damn thing about her Ex, and nothing negative about her job... in this day and age she should be blessed she is working. Wanda felt he was rude and they ended what they had. Do you think Ezra was insensitive and Wanda was better off without Ezra?

“Cassandra” the name used by the Connecticut Supreme court, was diagnosed with Hodgkin's lymphoma in September, but decided she did not want to complete the prescribed treatment. Her mother supported this decision, but the Department of Children and Families stepped in and ordered her mother to comply with the doctor's treatment recommendation. Both the mother and the daughter appealed this decision to the state’s highest court, which then decided that the 17-year-old lacks the maturity to make such a grave decision and denied her request that she be allowed to make her own medical decisions. Stanislaus County Dist. Atty. Steve Jacobson was arraigned in Department 2 on April 14, 2015, that would be the courtroom of Judge McFadden.
The case number is 1492609. On March 3, the case was on intake and a judge was assigned.
The case is Superior Court of California, Stanislaus County versus Steve Jacobson.
The case type is criminal.
On March 24. there was a hearing on an order to show cause in Department 2.
On April 14, there was an arraignment again in Department 2.
On May 15, there will be a law and motion hearing.
That’s all we know, based upon a sketchy court report.
