Michelle Ievoli - Wilmington, DE is fighting the ghosts of Countrywide - the bank that's gone with the wind but left all of its demons behind...The Proof of Claim states that US Department of HUD is her servicing agent, which is incorrect. Attorney Linda Tirelli (NY)
- is representing a local homeowner in bankruptcy, alleges in court papers that the Wells Fargo manual sets forth “in detail a procedure for processing notes without endorsements and obtaining endorsements and allonges.”
New York Attorney General Eric Schneiderman and three major regulators are investigating allegations made in a federal court case. that Wells Fargo has set up detailed internal procedures to fabricate foreclosure papers on demand.
Attorney Tirelli was also in the headlines last summer with this story:
Bank of America, the second-biggest U.S. lender, rewarded staff with cash bonuses and gift cards for meeting quotas tied to sending distressed homeowners into foreclosure, former employees said in court documents.
Attorney Tirelli, a White Plains, New York-based lawyer who represents clients seeking modifications from Bank of America, included these affidavits in a letter to the NY State Attorney General dated June 13.

"the daily complaint"
Every weekday we answer client complaints on The Daily Complaint to provide direction and resources for both the person complaining as well as other consumers experiencing similar issues whether it be mortgage fraud, loan servicing escrow issues, loan modification runarounds or denials, short sale refusals, deed in lieu negotiations and credit card debt collector abuses and fraud violations.
I routinely look for posts to answer in hopes that it will not only bring optimism to those homeowners and borrowers in distress but also some basic information to assist in fighting the banks that are "too big to fail" like Bank of America and Citi but yet don't appreciate the bailout that we provided in their time of need. The debt collectors like Ocwen and Nationstar are simply just piranhas but they can be beat at their own game too just like the big banks can be defeated.
We are committed to answering consumer complaints and addressing everyday credit and debt issues on The Daily Complaint and I thank you for your continued support!
We hope you enjoy the Show...

Grace Ross (MA) - Coordinator at Mass Alliance Against Predatory Lending will discuss a bill that has been unanimously approved by the Massachusetts Senate (Bill S.1987) - a bill that would restore the titles of foreclosed properties to homeowners. Grace said the following about this bill:"This does NOT fix titles for those foreclosed. It wipes out the "former" owner's claims if you don't file your suit & a copy in the Registry in 1 to 3 years so the next owner keeps the home no matter what you can prove later"
We will also discuss some break through information on wider foreclosure issues.
***An invitation to Senator Michael O. Moore, a sponsor of this bill, to appear on this program, has also been extended.

Lee Perry (CA) - fighting foreclosure fraud on his own since 2009. His case is now in the Appellate Court. Lee would also talk about importance of this legislation - AB1240. This bill corrects statutory language that will require the recording of deed of trust loan assignments if the assignee wants to preserve the option of non-judicial foreclosure.

Are You Kidding Me?" 5) "Finding PETE"
***PETE is an acronym for "Party Entitled To Enforce" - the one (and only) party who has the legal right to modify a mortgage loan or to foreclose.
