The "discovery rule" in Arizona can be a tricky concept. Basically, in personal injury actions you have two years to file your claim. Often times the claim is for negligence (duty, breach, causation, and damages) and the clock "starts to run" when the injured person learns of the facts giving rise to the cause of actions. Listen in as Attorney Steve Vondran discusses the "discovery rule in AZ."

For most types of injury cases, the injured party would be far better served by proceeding on their own or "pro se" in legal parlance. In these cases where the injuries are NOT substantial and/or permanent or when there are NO complex issues related to liability and/or damages and the injured party believes he/she is capable of negotiating a satisfactory settlement, the injured party would be served by utilizing ediscovery to obtain the electronic data needed in order to facilitate a successful resolution.
eDiscovery has been described as e-mails, spreadsheets, word processing documents, audio, video, database information, and anything metastasized in a digital content.
In our eDiscovery Nuts and Bolts for Personal Injury Training Webinar we will show you how to draft an effective "Demand Letter" to the claims adjuster, request electronic discovery, file a "Legal Hold" notice, and prepare for the all-important Rule 26(f) Conference and Joint Case Management Plan.

Brad Bonilla – Austin, TX Personal Injury Attorney on the Myths & Misconceptions of 18 Wheeler & Com
In this episode Jack talks with Brad Bonilla, a 3rd generation Personal Injury Attorney with his Family owned Bonilla Law Firm in Austin, TX. Brad specializes in cases involving commercial and 18-wheeler accidents. During the interview he shares information we should be aware of if you or a family member is ever in an accident with a large commercial vehicle, especially an 18-wheeler.
News Flash: insurance companies are in business to minimize their risks and payouts. As a result, Brad Bonilla explains that in an accident with a commercial vehicle, it’s often the commercial insurer rushing to the accident scene as quickly as possible to gather as much evidence as they can to minimize any fault against their insured. In fact, in accidents with injuries, they’ve been known to go to the hospital to gather information on and from the injured victim to try and close the case before an attorney is even called.
One especially surprising piece of information which Brad shared is that when someone receives a monetary settlement from the at-fault party’s insurance company to pay for their medical care, the injured party’s medical insurance company can demand reimbursement for any monies they’ve spent on behalf of their insured. This is known as subrogation and most people are not aware of this.
Brad highlights the many important reasons why someone would want to use the services of a personal injury attorney that specializes in these types of cases when involved in an accident with a commercial vehicle.

About the author:
Life is full of challenges. I have experienced several events that shaped my life - some were traumatic like suicide and amputation; others more tame that deal with business and entrepreneurship. Instead of letting these experiences define me, I examined them to understand what happened and how to deal with and learn from them. Through my books, I share what I learned so you can cope or altogether avoid these life lessons.
Prioritizing personal goals will decide what is lost or gained in most cases. When recovery is ranked at the top, outcomes can be as good as it gets. If financial safety and security is protected, what is available will last longer. This may be one of the biggest surprises encountered in lifetime. Collisions have changed lives in an instant and what is done afterwards helps to move forward or be left behind.
Lets talk today about Basic Car Accident 101 When Needed Right Now.
Insurance Companies testifying in front of Congress is like a revolving door which provides them with legislation used in court, more tax exemptions and subsidies, the likes any group of citizens will never see, on top of many government official writing up this legislation and later going to work for Insurance Companies to assist them in finding the necessary loopholes, if they were not written into laws for insurer benefits in the first place.
Has Congress ever asked you to testify about the hardship caused by the actions of Insurance Companies or Employers regarding keep settlements or benefits? And if they did, would Congress really be listening? Would this be another case similar to the Anita Hill scandal which shows they indeed do what they want in spite of what is best for the people?
Today lets talk about Insurance Companies, their Lobbyist, Congress, and their impact on you.
One of the most difficult aftereffects of brain injury is losing oneself. Depending on the injury and which part of the brain is impacted determines the type of emotional and behavioral change in one’s personality. A person who was agreeable, complacent, reasonable, and calm before the injury may change drastically to one who is violent, depressive, or struggles with anger management. These effects are not easy for others to understand – BUT, have you thought how difficult it must be for the survivor? My panel, M. S. survivor, Lisa Dryer and Brain Injury survivor, GeorgeAnna Bell will join me to discuss this sensitive topic.
Every TBI survivor and caregiver has encountered a fork in the road that has diverted his or her life-plan. A car accident, a fall from the roof, doing one more chin-up, or a door literally slamming one in the face are just some causes of traumatic brain injury. College plans, walking down the aisle in the perfect dress, or the coveted job quickly slip from reality as dreams turn to struggle. These unexpected life-happenings that divert one from his or her chosen path in life can be devastating. But as Yogi Berra once said, "If you come to a fork in the road, take it." Life is all about choices!
