    We have been talking about Luke Pelham, barely 18 at the time of a horrible crime that took the life of his friend.  In the first interview we discussed Luke's birth, his early childhood and struggles that he has had throughout his life.  Struggling to fit into a judgemental and unforgiving world of people who do not understand disability.  Luke, having been in the special ed system his entire educational career, had done an excellent job of masking his problems in a superficial social setting.  That was the result of years of hard work and focus from his mother and special educators.  


    In this interview we will be discussing the basics of what happened that lead up to Luke being arrested and charged with Felony 1st Degree murder,  Under the Felony Murder rule, you do not have to actually harm nor kill anyone to be charged with this.  In Colorado, Felony Murder then becomes felony 1st degree murder (other states vary in the usage and wording) and carries an automatic mandatory minimum sentence of life without parole and in some cases the death penalty.  Even though the jury would have learned about Luke's disabilities and how they had an impact on his inability to foresee pieces of a puzzle coming together that would equal such a horrible crime, the jury is not allowed to know that the defendant is facing life without parole.  That means they are deliberating blindly.  

    The clarification that we will bring from this interview is that Luke was not a participant in the beating death of his friend, he did not know that his friend was going to be beaten in such a manner, Luke was not even present when the beating took place, he was outside of the residence.  Luke later called 911 to get medical help for his friend but in doing so would find himself at the police station talking to police.

    Luke Pelham is a young man who has struggled since birth with intellectual disabilties, spend his entire life fighting his way through the special education system.  His family had to continually seek out different programs that may work for him.  This took them on a journey that lasted Luke's lifetime.  In 2014 they had just returned to Colorado from California.  Luke wanted to spend a week with his old friends in Boulder while his mother reestablished housing in Boulder.  During that week he was made aware of a school in Boulder that had programs that could help him finish high school.  He continued to stay with friends, mom was purchasing a home in Boulder, Luke began classes.  The rest of this story talks about what happened next, the tragedy that not only took the life of Luke's friend, but took Luke's life as well.  Tune in to learn more about Luke's story and ways that you can help, not only Luke but, others who are in or will find themselves in a situation of being charged with a crime that they did not commit.

    SixEyes - News - Imprisoned NFL Running Back Lawrence Phillips Commits Suicide

    Ex-NFL running back Lawrence Phillips, who was convicted in Los Angeles and San Diego counties for attacks on girlfriends and running down several people with a car, was found dead today in his prison cell in an apparent suicide.


    According to the state Department of Corrections and Rehabilitation, the 40-year-old former Baldwin Park High School standout was found “unresponsive in his cell” at 12:05 a.m. by staffers conducting security checks at Kern Valley State Prison in Delano.


    “He was transported to an outside hospital where he was pronounced deceased at 1:27 a.m.,” according to a CDCR statement.


    Phillips, who played for the St. Louis Rams, Miami Dolphins and San Francisco 49ers during a three-year NFL career, had been housed in an “administrative segregation unit” cell since April 2015, when he allegedly killed his cellmate.


    Phillips was being prosecuted in Kern County on a first-degree murder charge for allegedly strangling 37-year-old Damion Soward.


    Phillips, who was a top running back at the University of Nebraska, had been serving a 31-year sentence for his Southern California crimes, including a 2005 conviction in San Diego for choking his ex-girlfriend into unconsciousness.


    In Los Angeles County, Phillips entered a no contest plea in December 2000 to one count each of inflicting corporal injury upon a cohabitant and making criminal threats against his then-live-in girlfriend.


    Phillips was convicted in October 2006 of seven felony counts of assault with a deadly weapon for aiming a car at a group of boys and young men after an August 2005 pickup football game near the Los Angeles Memorial Coliseum.


    Three people were struck by the car, and a fourth young man was injured when the car struck a bicycle which then hit him.
