In the computer age, 99% of all documents are created and stored electronically. Today, all litigants, pro se or otherwise, have a duty to request and disclose responsive electronic evidence in their cases. If you have a consumer debt case, debt collectors will seek to turn to the courts to squeeze money out of the already struggling poor and middle class.
Lawsuits to collect on bad debts have to be filed in the state where a debtor lives. And, location has become the new tool for debt collectors as some jurisdictions are more lenient than others. Large debt buyers use the relaxed rules of small claims and municipal courts to file suits that obtain little documentation of the debts they seek to collect. These courts allow for quick judgments when legally unsophisticated defendants fail to contest the suits. Once the debt collectors obtains a judgment, they use the full weight of the legal system to enforce it primarily by seizing assets, garnishing wages, and freezing bank accounts.

In this episode, we will explore the intricacies of consumer debt and how to effectively negotiate with a debt collector on a presumed debt. Lenders have written off over $3.2 trillion of consumer debt of all type since September 2007, according to Mark Zandi, chief economist of Moody's Analytics. That figure has risen since that time.
Also, more than 450 debt buyers have scooped up more than $100 billion in distressed loans last year, according to the latest estimates by Kaulkin Ginsburg, a debt-collection industry advisor.
Folks, there is a lot of debt to be collected and the debt collectors are coming! You need to know how to beat back the collection activity and learn how to negotiate effectively with the debt collector when he/she calls. Most times, the debt probably isn't yours, or the debt collector will not have the appropriate documentation to confirm the debt. We will train you how to recognize these and other characteristics to ensure you are not a victim in this consumer debt crisis.

We will continue the discussion of how to establish the paper trail in the event you will need to sue the debt collector, original creditor, or the credit bureaus for non-compliance with the Fair Debt Collection Practices Act (FDCPA), or Fair Credit Reporting Act (FCRA).
We will revisit the statute of limitations and its applicability, sample letters, and the method behind the negotiation strategy.
If you have been contacted by a debt collector, received your credit bureau report and have noticed derogatory items thereon, or just want to be proactive in keeping your credit and good name up to par, you must tune in!
