    IS ATTORNEY MCGRATH BEYOND STATUTES?

    Investigated investigators do not get prosecuted.


    Tampering with the jury is a felony, and that is exactly what Stanislaus DAs investigator Steve Jacobson and District Attorney Dave Harris are accused of in the trial of Aleo Pontillo, owner of AJ bail bonds.


    DA’S Fladager and Harris are being charged with contempt not a felony.


    The accusation is verified from a declaration by Judge Scott Steffen, who presided over the trial.


    The accusation was moved from Judge Steffens court to Judge Silveira and now resides with Judge Linda McFadden, who is holding Jacobson to a contempt charge.


    Attorney Frank Carson, who filed the complaint said, “I have no doubt that if I or my investigator had done the same thing to jury members in the same situation, we would have been arrested immediately, restricted from the courthouse and prosecuted on felony charges by the District Attorney’s Office to the fullest extent of the law.”

    Status of DACA (2012), Extended DACA (due 2/2015) & DAPA (due 5/2015)

    DACA that was granted on June 15, 2012 is still available. Extended DACA that should have become available on 02/18/2015 has been held up by the 5th Circuit Court of Appeals, and DAPA that should have become available as of 05/20/2015 has been held up by the 5th Circuit Court of Appeals.


    DACA of 2012 is still available. If one is in removal proceedings, and of an age younger than 31 on 06/15/2012, in school, or completed high school, have no felony or multiple misdemenor, you entered the USA before age 16, you entered before 06/15/2007, you may qualify for DACA of 2012.


    If you have met the above requirements except that you are not yet age 15 and not in removal proceeding, you have to wait until age 15 to apply for the 2012 DACA.

    DEFENSE AVOIDS STEFFEN MOTION TO DISMISS DENIED

    Trial of DA Harris and DA investigator Jacobson has been continued until July 27 2015.


    Tampering with the jury is a felony, the court can only deal with contempt.


    So far no agency is available to charge the two law enforcement officers with a felony.


    The decision could be made that Harris and Jacobson be suspended without pay until the matter is resolved.

    In a recent decision, Matter of J-H-J-, 26 I & N Dec. 563 (BIA 2015), the Board of Immigration Appeals held, An alien who adjusted status in the United States, and who has not entered as a lawful permanent resident, is not barred from establishing eligibility for a waiver of inadmissibility under section 212(h) of the Immigration and Nationality Act, 8 U.S.C. § 1182(h) (2012), as a result of an aggravated felony conviction. Matter of E.W. Rodriguez, 25 I&N Dec. 784 (BIA 2012), and Matter of Koljenovic, 25 I&N Dec. 219 (BIA 2010), withdrawn.


    When Congress amended the immigration laws a few years ago, it disallowed green card holder the ability to cancel deportation if that person committed an aggravated felony. For a number of years now, the various federal circuit courts of appeals struggled with the issue of whether a person who adjusted status in the US is still eligible for a discretionary waiver after committing an aggravated felony.  Most circuits (2nd, 3rd, 4th, 5th, 6th, 7th, 7th, 9th, 10, & 11th). The 8th circuit said no, Roberts v. Holder. The 1st circuit has not decided that issue. The BIA in a minor holding said that since most circuits (9 out of 11 said yes it have to create uniformity through the country. If you consular processed for your green card, no waiver is available for an aggravated felony.

    Percy Isgitt Arrested on Felony Charges. Flight Risk With 250,000 Bail

    High flight risk Houston Criminal Attorney Percy Lawayne Isgitt was arrested February 26, 2015 for MISAPP / FIDUCIARY / FINANCIAL OVER 200K in Harris County Texas. Percy Isgitt was already facing civil charges for stealing $275,000 from his lifelong family friends the Jordan Family. Isgitt's recent legal troubles include being sued by Amercian Express for $24,000 followed by his wife of 50 years divorcing him in January, the highly public fraud he committed against his best friends and now being arrested.  Amanda Brooks and  Jill Brenneman have been public about the physical, emotional, sexual and financial crimes against them by Isgitt but Brooks and Brenneman struggled to gain mainstream respect because we are sex workers. Amanda and Jill explain one of Isgitt's probably motives for stealing these funds. In the Spring of 2014, after the funds were stolen, Isgitt hired surveiilance of Jill. The surveillance team eventually beat Jill, who now suffers a terminal medical illness as complications from these beatings. Isgitt has continously attempted to find Amanda Brooks location from friends. If given the chance Isgitt will likely jump bail to Puerto Penasco, Mexico with the assistance of his Phoenix based agent and proxie, a convicted felon private investigator.     From stealing candy bars in corner stores to breaking and entering with intent to commit a felony, Mehlek's life was once full of rebellion, deviancy and mischief. Although born and raised by both his paternal parents, Mehlek found himself constantly in trouble with the law, in school and at home. His life was suddenly shaken after being arrested for burglary in Aug 2005. After pleading guilty to two felonies and a misdemeanor, his 25 years worth of prison charges were reduced to a mere 5 years of probation with time served.

    A growing number of states are pushing inmates out of prison in early release programs designed to reduce overcrowding and save money. But faced with a tight job market and few employers willing to hire someone with a criminal record, many former inmates are likely to end up right back behind bars.


    Last month, California began releasing prisoners deemed at low risk for re-offending. Colorado, Oregon, Kentucky and Connecticut, all wracked with budgetary issues, have instituted similar moves as a way to cut costs, while others, including Michigan and Mississippi, are considering similar initiatives.

    TPS FOR LIBERIA, GUINEA, & SIERRA LEON

    Temporary Protected Status (TPS) is a special benefit that the United States gives to citizens and national of certain countries. This grant of benefit could be based on a number of things: earthquake, civil war, or some type of natural disaster. War in one’s country seems to be more common. On or about November 19, 2014, the United States government gave citizens & nationals from LIBERIA, GUINEA, & SIERRA LEONE who were present in the U. S. on 11/19/14 #TPS. Citizens and nationals form the above named countries who may qualify for #TPS needs to apply by 5/18/15 to secure such a benefit. If a person does not apply by 5/18/15, (s)he may miss the opportunity to obtain TPS.This round of TPS lasts 18 months.  With a work permit one can apply for a social security card. You can work lawfully and you may obtain a driver’s license. Always try to have date stamped documents in your name. Try not to commit crimes. Two or more misdemeanors could cause you to lose #TPS. If you get a Felony, your TPS evaporates; it will not be renewed when it expires. Provided one does not commit crimes and (s)he timely renews during the registration period, the US government will not remove you to your country of citizenship/your usual place of residence. Check my book out for more tips on TPS. If you are in removal proceedings and you are from one of the above mentioned countries, an Immigration Judge (IJ) may grant you TPS. Matter of Lopez-Aldana,If the IJ denies your TPS, you may seek review at the Board of Immigration Appeals (BIA).
