The closest the Supreme Court has come to embracing the anti-humiliation principle is through its use of the term “dignity.” This link should be intuitive—what, after all, is the opposite of “humiliation” but “dignity”? Ackerman recognizes this nexus, but his discussion of it is tantalizingly brief.26 He acknowledges that the link between human dignity and the anti-humiliation principle may be unfamiliar to American constitutional lawyers, given that, in contrast to other jurisdictions, our constitutional traditions are built around the concepts of equality and liberty.
Warren was simply calling upon judges, and the rest of us, to make common-sense judgments about the prevailing meaning of social practices. One of the greatest legal thinkers of the era, Karl Llewellyn, persuasively argued that judges couldn’t decide the most humdrum case without relying on this capacity, which he famously called “situation-sense.”It was Louis Brandeis, not Thurgood Marshall, who first used social science to convince courts to consider the real-world impact of their doctrines. As early as 1908, the Supreme Court relied heavily on his famous “Brandeis Brief” in upholding maximum-hours laws for women. During the following decades, the law schools became centers of sociological and economic critique of the regnant legal formalism The Anti-Humiliation Principle and Same-Sex Marriage Kenji Yoshino

As I promised yesterday, I made the decision to do a special show today on this issue of gay marriage yet again. I know, it's old hat for me, old hat for this show, old hat for some of you. But I saw an article a couple of days ago that as I said, to me it's a most read for all Americans with what the Supreme Court is hearing arguments over right now. I'll have that article on the Facebook page so you can read it. But I wanted to discuss some of the finer points of it today, because to me it really hits on not only what has happened in Canada with the legalizing of gay marriage 10 years ago. It hits on what is already beginning in the United States. I'll try to reference how on the show today, beginning at 4:30 Eastern time and archived afterward.
"The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress; provided that no amendment which may be made prior to the year one thousand eight hundred and eight shall in any manner affect the first and fourth clauses in the ninth section of the first article; and that no state, without its consent, shall be deprived of its equal suffrage in the Senate. " Article Five of the United States Constitution describes the process whereby the Constitution may be altered. Altering the Constitution consists of proposing an amendment or amendments and subsequent ratification.."

Civil Rights, as it relates to the debased level of civilization in the Republic of the United States of America is one of the most controversial and troubling issues in the modern world of civics, law and social intercourse. Civil Rights in a more proper sense, Civil Liberties treat the issue of rights, liberties, immunites, privileges and protections of the sovereign right of the "People" or in a contractual sense, the citizens of a Nation State, Association or political body. - Moors Order of the Roundtable -
Susan Watson was appointed Executive Director of the ACLU of Alabama on April 15, 2013. Prior to coming to the ACLU of Alabama, Watson served as the Regional Director of the ACLU of Florida. Watson’s first activity with the ACLU was in 1997 when the Florida Legislature and then Governor Jeb Bush passed a voucher scheme to divert money from public schools to private and religious schools. Susan volunteered her children to be plaintiffs in contesting the law. Susan and her children prevailed in this lawsuit, protecting public education in the state of Florida.
In 2000 she and others revitalized a long dormant ACLU chapter in Pensacola and she served as the first Panhandle Chapter Chair. Susan also served on the State Board of Directors of the ACLU of Florida and held several positions on the Board’s Executive Committee. Susan joined the staff of the ACLU of Florida in June of 2005 as director of the Northwest region of the ACLU of Florida which stretches from the Alabama line east to Jefferson County.

Constitution Corner: Nullification is a natural right, but not the only tool to restore the Republic; The belly of the beast in a depraved society, a.k.a. Doug Gibbs' weekend at USC; Mike Huckabee is in, Marco Rubio is glory-trolling, Jeb Bush is in the wrong party, Clinton Foundation stench driving away Hillary! '16 donors, and Rand Paul doubles down on his dad's isolationism; There another economic crash coming, and this one will be permanent; After six and a half years of endless post-White House abuse, George W. Bush finally fires back; and a mere two hours from now, witness history.
The Senate led by the ‘severely conservative’ McCONnell Republitards fast-tracked trade promotion authority, which is a fancy way of saying legislative power to the Imperial Puppet trumping The Constitution. McConnell pushed for Patriot Act Extension, especially section 215–NSA bulk data collection or domestic spying over and against Rand’s filibuster and objections after Mike Lee failed to secure 60 votes for the USA Freedom Act phony reform. Then they recessed for Memorial Day Week to pretend to remember the war dead; Americans who served gallantly in banker’s wars and died to secure global dominance for transnational oligarchs under the guise of defending your freedom. Freedom is slavery, war is peace, ignorance is strength.
The Constitutional Republic has been usurped by the tyranny of soft despotism with a veneer of democracy, elections and the distraction of bread and circuses. It shall persist UNLESS liberty-loving people band together to restore Constitutional governance from your own community on up to the District of Corruption. Restore The Constitutional Militia of the Several States, sound money, free economies, religious and civil liberties as well as a sensible foreign policy of trade, friendship and non-interventionist defense backed up by the most powerful Navy and Marines; or watch the fascists in both parties push transnational agendas to their benefit and our demise. This is the last chance to stop those who perpetuate a hegemonic empire abroad and a fascist police state at home. To defeat the lawless hordes of Cultural Marxists, fascists, oligarchs, kleptocrats, useful idiots and their fellow travelers especially the Democrat-socialists, first you MUST CRUSH the Neocon fascist-socialists on ‘the right’. . .for liberty!
