WHAT WE HAVE HERE----IS A FAILURE TO COMMUNICATE!Old School American Network Is Evolving. The "NEW" Patriots Fire Show is part of that evolution. This is a desperate plea to our political leaders and members of our press:
I need you to help me. I am an American Citizen who went to Iraq to support this nation in its hour of need. Regardless of your political view, many Americans are suffering and dying because of medical abuse or neglect in the DBA System. I came out of Iraq a broken person tossed around year to year in a sea of red tape and apathy. I did what was asked of me and only ask to be treated with dignity and respect. I not ask to be hurt, yet I did ask to be treated for my injuries as prescribed by law. I worked for KBR from 2004-2005 and was injured on five occasions. On my fifth injury under extreme stress, I quit KBR and ran to states. I immediate asked for help and received little to this date. Why? For the first year coming home I tried to work it out without an attorney, but AIG forced me to hire an attorney after playing around with me and my family's welfare. I hired which I was told by the DOL and others an attorney that was top in the field. That was a lie. He mislead me, did not listen to me, laughed at me, never came to see me, made travel 5 hours to see him, never showed up to depositions, never received over $1,000 of travel or medical related expenses, misrepresented me, and lied to me directly in mediation with AIG. He released private and personal records or statements of my case to some people not authorized to view or hear without my permission. I fired him because of the many lies I caught with him. During the time he was my consul he was collaborated with AIG attorneys and other that wheel & deal cases. He collaborated with attorneys across the country along with one of the largest and most influential law firms on book that was adopted by the DOL and many law schools. This book is the “New DBA & WHA Handbook.”
I have a good attorney now, but he can not change the problems with the system. The Defense Base Act is administered & supervised through the Department of Labor. Workers are being tossed aside like disposable razors. They have to wait years even to get the most basic issues resolved. The average case takes from 3-4 years with no grantee of resolution or benefit. Nobody could replace the lost years or miss- opportunities that the insurer has taken away from an injured contractor. The DBA Workers Comp System has no recourse for their actions or delays; they refuse reward compensation for such criminal action. Non-treatment by the Employers & Insurers should be considered a in criminal light, but our "politically correct society" today says NO.....The system is broken and has little oversight. There are NO real stats or tracking unit for thousands of hard-working Americans that work in the Middle East day to day since 2003. According to the "CRS Report For Congress and the web site www.americancontractorsiniraq.com," the stats from 3/17/07 there were 917 civilian deaths and over 12,000 wounded. These are Americans. Did you realize that 65% of contractors overseas are veterans of service to this nation? Did you know "Priority 8 Section in the VA Benefit Package" blocks veterans from using their benefits for treatment of their injuries when the AIG refuses to treat them? Many of these veterans never even leave Iraq; they complete their time of duty and sign onto the contract companies.
My story is complex but important, I would like to sit down and explain the whole scenario. AIG and KBR have been under investigation for many allegations. KBR is responsible and does not follow-up on its injured people. KBR is responsible and could have avoided some of my injuries. They were sited and warned about the many hazards in Iraq, but they could care less. They take people who need that wage in a war zone that have to keep their job to support their families. They lie and changes things quickly; you never knew what was going to happen next. Corporate crime and corruption is running rapid, we need to stand up and make them own up to their contracts they signed and the contract they were paid for. AIG has refused me to see a doctor, they refuse to pay past wages, they refuse to pay mileage or other related cost, they refuse have all injuries reviewed by a doctor which was order by my specialists & the New York Office Workers Comp in 2006, they refuse to follow the law according to weekly wage benefit, they refuse me pain management or medication, they refuse to have case reviewed as prescribed by law in workers comp case to update injuries, and they have threatened - intimidated me to settle out of court by saying IF I did not accept their offer I would lose everything. Also that they would draw out the case with appeals even if I win and wait more years!
The Defense Base Act is horrible written and one-sided. It includes NO provisions for punishment or tracking of the insurers that continue to violate the law. If a client violates the law, they are investigated and put in prison to lose benefits forever. Why isn't it that for the Insurance Industry? Are they above the law? Are they better or more important than the average America?
The problem is they do not put their lives on the line supporting the troops who support this nation. Insurance agents, DOL adjusters, judges, or attorneys don't go into the "War Zone" with out troops. They share no responsibility or burden; they just reap all the rewards! Please help me. Listen to my story. It is one of many and we deserve to be treaty with dignity and respect.
