Today's show deals with WWII Veterans who are known for their strength and perseverance. Their stories will soon be all we have to honor the valor and sacrifice of the greatest generation. The remaining time we have with these hero's is fading and that is why our special guest today is world renounced author, Howard Layton. In his new book, Layton recounts his adventures as Royal Airforce Navigator, provides the only personal account of victory at El-Alamein and talks about his love won and lost during the war. "Love and Sand: An RAF Flyer's Memoir of Love, Lies, and Mayhem in the World War II Deserts of North Africa. This is a desperate plea to our political leaders and members of our press:
I need you to help me. I am an American Citizen who went to Iraq to support this nation in its hour of need. Regardless of your political view, many Americans are suffering and dying because of medical abuse or neglect in the DBA System. I came out of Iraq a broken person tossed around year to year in a sea of red tape and apathy. I did what was asked of me and only ask to be treated with dignity and respect. I not ask to be hurt, yet I did ask to be treated for my injuries as prescribed by law. I worked for KBR from 2004-2005 and was injured on five occasions. On my fifth injury under extreme stress, I quit KBR and ran to states. I immediate asked for help and received little to this date. Why? For the first year coming home I tried to work it out without an attorney, but AIG forced me to hire an attorney after playing around with me and my family's welfare. I hired which I was told by the DOL and others an attorney that was top in the field. That was a lie. He mislead me, did not listen to me, laughed at me, never came to see me, made travel 5 hours to see him, never showed up to depositions, never received over $1,000 of travel or medical related expenses, misrepresented me, and lied to me directly in mediation with AIG. He released private and personal records or statements of my case to some people not authorized to view or hear without my permission. I fired him because of the many lies I caught with him. During the time he was my consul he was collaborated with AIG attorneys and other that wheel & deal cases. He collaborated with attorneys across the country along with one of the largest and most influential law firms on book that was adopted by the DOL and many law schools. This book is the “New DBA & WHA Handbook.”
I have a good attorney now, but he can not change the problems with the system. The Defense Base Act is administered & supervised through the Department of Labor. Workers are being tossed aside like disposable razors. They have to wait years even to get the most basic issues resolved. The average case takes from 3-4 years with no grantee of resolution or benefit. Nobody could replace the lost years or miss- opportunities that the insurer has taken away from an injured contractor. The DBA Workers Comp System has no recourse for their actions or delays; they refuse reward compensation for such criminal action. Non-treatment by the Employers & Insurers should be considered a in criminal light, but our "politically correct society" today says NO.....The system is broken and has little oversight. There are NO real stats or tracking unit for thousands of hard-working Americans that work in the Middle East day to day since 2003. According to the "CRS Report For Congress and the web site www.americancontractorsiniraq.com," the stats from 3/17/07 there were 917 civilian deaths and over 12,000 wounded. These are Americans. Did you realize that 65% of contractors overseas are veterans of service to this nation? Did you know "Priority 8 Section in the VA Benefit Package" blocks veterans from using their benefits for treatment of their injuries when the AIG refuses to treat them? Many of these veterans never even leave Iraq; they complete their time of duty and sign onto the contract companies.
My story is complex but important, I would like to sit down and explain the whole scenario. AIG and KBR have been under investigation for many allegations. KBR is responsible and does not follow-up on its injured people. KBR is responsible and could have avoided some of my injuries. They were sited and warned about the many hazards in Iraq, but they could care less. They take people who need that wage in a war zone that have to keep their job to support their families. They lie and changes things quickly; you never knew what was going to happen next. Corporate crime and corruption is running rapid, we need to stand up and make them own up to their contracts they signed and the contract they were paid for. AIG has refused me to see a doctor, they refuse to pay past wages, they refuse to pay mileage or other related cost, they refuse have all injuries reviewed by a doctor which was order by my specialists & the New York Office Workers Comp in 2006, they refuse to follow the law according to weekly wage benefit, they refuse me pain management or medication, they refuse to have case reviewed as prescribed by law in workers comp case to update injuries, and they have threatened - intimidated me to settle out of court by saying IF I did not accept their offer I would lose everything. Also that they would draw out the case with appeals even if I win and wait more years!
The Defense Base Act is horrible written and one-sided. It includes NO provisions for punishment or tracking of the insurers that continue to violate the law. If a client violates the law, they are investigated and put in prison to lose benefits forever. Why isn't it that for the Insurance Industry? Are they above the law? Are they better or more important than the average America?
The problem is they do not put their lives on the line supporting the troops who support this nation. Insurance agents, DOL adjusters, judges, or attorneys don't go into the "War Zone" with out troops. They share no responsibility or burden; they just reap all the rewards! Please help me. Listen to my story. It is one of many and we deserve to be treaty with dignity and respect.

FOR IMMEDIATE RELEASE Contact: Kawika Riley (Veterans’ Affairs) October 10, 2008 (202) 224-9126 SWEEPING VETERANS’ MENTAL HEALTH BILL NOW LAW Akaka’s legislation was inspired by first-hand accounts from veterans and their families WASHINGTON, D.C. – U.S. Senator Daniel K. Akaka (D-HI), Chairman of the Veterans’ Affairs Committee, issued the following statement today regarding enactment of S. 2162, the Veterans Mental Health and Other Care Improvements Act of 2008. S. 2162, introduced by Senator Akaka and cosponsored by a bipartisan group of Senators, makes various improvements to veterans’ mental health and other forms of care. The bill pays tribute to Justin Bailey, an Iraq war veteran who returned from combat only to lose his life to PTSD and an accidental overdose of prescription medications. “Now that S. 2162 has been enacted, VA can incorporate these provisions to improve its strategy against the injury and enemy of PTSD and other invisible wounds,” said Akaka. In his floor statement urging passage of S. 2162, Akaka detailed the origins of his legislation: “The legislation did not stem from a lobbyist or an interest group. It came about because of one letter – a letter to me from the parents of Justin Bailey – Mary Kaye and Tony Bailey. “Justin Bailey was a war veteran who survived Iraq only to die while receiving care from VA for PTSD and substance use disorder. A week after his death last year, Justin’s parents were naturally heartbroken by the death of their only son, but even more than that, they were concerned that other veterans might share his fate if VA mental health care did not improve,” said Akaka. The Bailey family has worked actively to improve veterans’ mental health, testifying before the Veterans’ Affairs Committee and supporting S. 2162. S. 2162’s improvements to veterans’ mental health care include: Setting a standard minimum level of care for substance use disorder, and creating innovative enhancements to treatment Improving treatment to veterans with multiple disorders, such as PTSD and substance use disorder Mandating a review of VA’s residential mental health care facilities, to ensure that they are adequately staffed Creating a research program on PTSD and substance use disorder, in cooperation with the National Center for PTSD Enabling VA to provide mental health services to veterans’ families, and setting up a program to aid the families of returning servicemembers S. 2162 also makes significant improvements in other areas of veterans’ health care: Rural Veterans: More than doubles the beneficiary travel mileage reimbursement (from 11 to 28.5 cents per mile) eligible veterans can receive for travel to receive VA care, permanently sets the deductible to $3 each way for such travel, creates a pilot program on the use of peers to enhance outreach to rural veterans, and encourages coordination between VA and rural community-based resources. Emergency Care for Veterans: Corrects current procedures used by VA to reimburse community hospitals for emergency care provided to eligible veterans. VA Epilepsy Centers of Excellence: In recognition of the link between traumatic brain injury, a signature wound of the current conflicts, and epilepsy, establishes up to six VA Epilepsy Centers of Excellence focused on research, education, and clinical care for epilepsy. Veterans’ Pain Care: Requires a pain care program, including care for acute pain, for all VA inpatient facilities for long-term mental health and substance abuse care and to prevent long-term chronic pain disability, expands VA health care staff education on pain assessment and treatment, and increases VA research on pain care. Veterans’ Caregivers: Extends authority for VA to provide institutional and non-institutional long-term care and caregiver assistance services. Medical Construction: Authorizes a series of major medical facility construction projects and outpatient clinic leases. Homelessness: Creates targeted programs to assist low-income veterans, and increases funding capacity for the successful VA Grant and Per Diem program, which assists community-based organizations that serve homeless veterans. Rehabilitating Veterans: Expands a program to help formerly incarcerated veterans reintegrate into society through employment counseling and other services. S. 2162, introduced by Chairman Akaka, was reported by the Senate Committee, then passed the full Senate unanimously before being amended and passed in the House, then passed again in the Senate. President Bush signed the bill into law on October 10, 2008.
