Roberts to Questions From Senator Mitch McConnell Professor of Law, Director Sports Law Program Re: Follow-up Questions to College Bowl Alliance Hearing Question 1.—High Costs of Litigation I hesitate to hazard a guess as to what the parties’ costs would be in a full blown rule of reason litigation over the Bowl Alliance. In such cases, the extent of discovery, the number of pre-trial motions, and the length of trail could vary enormously depending on the strategies, tactics, and issues each side would choose to raise and pursue as well as the skill and patience of the judge. However, in order to take the case through to a jury verdict as well as though the prolonged appeals that inevitably follow, “a few million dollars” of expenses for each side is certain. I also believe that such a case would take no less than three and possibly ten or more years to run its course, depending on if counsel are reasonable and cooperative during discovery and whether there are any mistrials or remands for retrial. *** July 7, 2009 The Bowl Championship Series: Is it Fair and in Compliance with Antitrust Law? Mr. Benson. Out of the 10 that will probably make that decision, even though there may be five other presidents on the board of I-AA, I-AAA. But inasmuch as this would be a I-A issue, the number of presidents who would make that decision would probably be ten.” P. 82 of document (p.88 of .pdf) Senator DeWine: Let me ask Mr. Richardson and Mr. Peace, as student-athletes, what is your opinion about a playoff? Do you have an opinion about that? Mr. Peace: If I had to give my opinion on a playoff, if you had asked me maybe before all of this had happened with the bowl games, I would probably be in favor of a bowl system just because, you know, it gives us a chance to go somewhere sunny, which in Wyoming is pretty big deal for us, you know, and have that experience. You know, you get, you know, lots of extra clothes and, you know, things to give to your family. But after I see what can happen, you know, in the bowl system when, you know, out of 112 Division I schools there were only seven that had a higher winning percentage than the University of Wyoming—there were schools that were 6-5 playing in bowl games and we were just eliminated. I don’t know why and I don’t see why, and right now I feel that the only way that any and every team in the Nation is going to get a fair chance to, I guess, have a national title hope is through a playoff system. That is the only way that I can think of right now, unless they restructure the bowl system that would be fair to all schools, which is, you know, all that we ask.” Ask Bill (913)341-8151 http://www.youtube.com/watch?v=dd_xLXzxwCI 00:27:00KennedyProposalnoEastern Washington,Kennedy Proposal,Rose Bowl,Investigation,Brandon Kennedyhttp://www.goeags.com/sports/m-footbl/2010-11/releases/10fbDec17VillanovaRecap May 22, 1997 Antitrust Implications of the College Bowl Alliance P. 80 (pSiege the BCShttp://www.blogtalkradio.com/kennedyproposal/2010/12/16/siege-the-bcsCulturehttp://www.blogtalkradio.com/kennedyproposal/2010/12/16/siege-the-bcs/#commentshttp://www.blogtalkradio.com/kennedyproposal/2010/12/16/siege-the-bcsThu, 16 Dec 2010 04:00:00 GMTSiege the BCSPlayoff PAC asked that the appropriate parties bring the appropriate actions against the violators of “important state campaign finance laws” and the result has led to the Attorney General of Arizona to impanel a grand jury. But soon, other people will ask him why 25% of the bowls of the agreement he oversees is receiving attention from the Arizona’s AG. That would be more continued silenced for Mr. Hancock because like said before; Mr. Hancock knows who organizes the Fiesta Bowl. If Dan Wetzel is a “friend” of Mr. Hancock, wouldn’t Fiesta Bowl CEO John Junker be too? Hancock’s use of “friends” is interesting. Wetzel doesn’t believe that the BCS is in the best interests of the schools.Doesn’t Junker believe the BCS is in the best interests of the schools? Yes. That is why they cheat and break laws. They don’t feel that anyone will ever step to them. I celebrate Playoff PAC’s efforts. This legal complaint has Bill contemplating what comes next. THis shows us, as citizens, we have the right to file complaints when people are violating laws. The KP Coalition has not filed an antitrust complaint. We have recieved a response from Washington State University and will be one step closer to recieving the University of Washington's. Nov 22, 2010, NPR invited Wetzel and Hancock to talk about the Football Bowl Subdivision (FBS) post-season. Hancock was faced with the question form Neal Conan, “Is it time to stop a system that enriches only a few people and institute a playoff system that would enrich the colleges and the universities.” Hancock responded no. What playoff money is available for the NCAA? Some have claimed a 16 team, home hosting model, is the only workable solution, but is that money available right now? And do the schools want to pull out of the BCS to enter a 16 team playoff world? The Kennedy Proposal (KP) ask the BCS Presidents to expand the two team, one game tournament. The Pac 10 was expanded, the MWC/WAC has changed, Big Ten expanded, Big East expanded. All of this is affecting regular season scheduling, the bowl structure, and the BCS. Expansion is occurring and the option to expand the BCS tourney is available. More money would be the result. The case, however, is not only that there is more money, but the money afforded by the KP is in addition to the current revenue generated by the current system. Jim Delany estimates about three to four times more money. 00:28:00KennedyProposalnoBill Hancock,Brandon Kennedy,Kennedy Proposal,Antitrust,JusticeIn response to TCU's decision to enter the Big East, ESPN broadcaster Lou Holtz said he expects more changes within the BCS because he feels the administratorsDecember Kickoffhttp://www.blogtalkradio.com/kennedyproposal/2010/12/04/december-kickoffCulturehttp://www.blogtalkradio.com/kennedyproposal/2010/12/04/december-kickoff/#commentshttp://www.blogtalkradio.com/kennedyproposal/2010/12/04/december-kickoffSat, 04 Dec 2010 17:00:00 GMTDecember KickoffBCS, BCS, BCS. 00:28:00KennedyProposalnoNCAA,Bill Hancock,Brandon Kennedy,Justice,CongressBCS, BCS, BCS.Bracket Creep, 16-team Playoff, and Calling the Copshttp://www.blogtalkradio.com/kennedyproposal/2010/11/21/bracket-creep-16-team-playoff-and-calling-the-copsLegalhttp://www.blogtalkradio.com/kennedyproposal/2010/11/21/bracket-creep-16-team-playoff-and-calling-the-cops/#commentshttp://www.blogtalkradio.com/kennedyproposal/2010/11/21/bracket-creep-16-team-playoff-and-calling-the-copsSun, 21 Nov 2010 05:00:00 GMTBracket Creep, 16-team Playoff, and Calling the CopsToday we will talk wins and losses, bracket creep, 16 tam Playoff, Calling the Cops, and of course, Money.00:30:00KennedyProposalnoBCS,Bill Hancock,Brandon Kennedy,Justice,AntitrustToday we will talk wins and losses, bracket creep, 16 tam Playoff, Calling the Cops, and of course, Money.Re-Hashing Hancock's Interviewhttp://www.blogtalkradio.com/kennedyproposal/2010/11/17/re-hashing-hancocks-interviewNewshttp://www.blogtalkradio.com/kennedyproposal/2010/11/17/re-hashing-hancocks-interview/#commentshttp://www.blogtalkradio.com/kennedyproposal/2010/11/17/re-hashing-hancocks-interviewWed, 17 Nov 2010 15:30:00 GMTRe-Hashing Hancock's InterviewExecutive Director of the BCS Bill Hancock participated in an interview with Sports Illustrated Dan Patrick last Tuesday. Hancock takes a presumed current system stance but we in the KP Coalition are pro-current system too. The BCS tournament currently affords two participants the right fight for the glass football. With the expansionary package afforded by the KP, each BCS participant could participate for the crown. Patrick's claim that the month of December could be owned by the FBS is enitirely true but with ownership comes money and that is why the conference commissioners will not concede to a NCAA sanctioned tournament. If Delaney has said that "$700-$800 million" could be brought in by a playoff then that further clarifies why they oppose such an event. The BCS distributes about $500 million from their broadcasting contest with ESPN. Which is less than what could be generated by a playoff. This whole thing is not about the size of the cake. Even if Delaney were to go on record saying there is billions of dollars in a playoff, the "good ol boys" still would not concede to the public's "fixation" of money. It's all about money for them too but a playoff gives the knife to the NCAA. 11 conference commissioners and administrators at Notre Dame do not want to hand the knife to the public.
