For several months peaceful protestors have had their First Amendment right trampled over due to the harsh criticism of local, state and federal government. Segment 3 of today's show will focus on the intersection of the First Amendment freedom of speech rights and the government’s ability to regulate, and in some situations ban lawyer advertising.  Restrictions are typically enforced through the individual state agencies, commonly referred to as the State Bar. Transmitters/towers exist throughout the BART system providing cellular coverage. BART maintains physical control over the towers, including providing electrical power. On 07/03/11, BART police shot and killed Charles Hill at its Civic Center Station in San Francisco. Hill was a homeless man who was allegedly inebriated, and was reportedly armed with a bottle, two knives, and was “acting aggressively” toward police. A month later, BART claimed “[o]rganizers plann[ed] to disrupt BART service on August 11, 2011... us[ing] mobile devices to coordinate their disruptive activities and communicate about the location and number of BART Police” in response to the killing. BART officials cut off power to all phone towers from 4:00pm to 7:00pm in an attempt to thwart the alleged protest. In the process, everybody (including non-protestors) lost mobile phone service in BART stations. [LEGAL ISSUES] (1) Did the “credible information” obtained by BART, claiming a protest on 08/11/11, satisfy the 3-pronged test in Brandenburg v. Ohio for infringing upon speech rights? (2) Even if the Brandenburg test was met, was cutting phone service still an unconstitutional prior restraint, particularly when BART recognizes portions of its stations are open for lawful protest? Hosted by: Nnenna Olu and Rita Asiedu Guests: ACLU's Katie Parker and Jimmy Dixon from the House of Representatives A New North Carolina legislation N.C. 90-21.85 requires the physician before performing an abortion, to perform an obstetric real –time view of the unborn child on the pregnant woman. The legislation also requires the physician to simultaneously explain what the display is depicting, which included the presence, location, and dimensions of the unborn child within the uterus and the number of unborn children depicted. The doctor may offer the pregnant woman an opportunity to hear the fetal heart tone. Additionally, the physician is required to display the images so that the pregnant woman may view them. Lastly, the physician shall obtain a written certification from the woman, before the abortion that the requirements have been complied with. The statute allows the father or any person upon whom an abortion has been performed may maintain an action for damages against the person who performed the abortion in knowing or reckless violation of the article. A plaintiff may also seek injunctive relief against the doctor from performing further abortions in this state.
