We will be discussing cyberbullying in the context of if school systems have any recourse to combat cyberbullying that occurs off campus without infringing on the first amendment. Students first amendment rights while on school premises are curbed to a degree to foster the learning experience. Off campus students are essentially given the full protections of the 1st amendment. Can or should schools be able to punish students for activity on the internet that occurs off campus and does not violate other laws/ regulations (ie underage drinking fighting)? Would like to bring up some highly publicized cases of cyberbullying and address some of the laws being passed as well as some that have already been struck down as to broad on this topic.
