We all know what a prenuptial agreement is and how it can possibly be a contentious issue going into a marriage. Is there an equivalent in retail? The Co-Tenancy Clause can protect you should there be a "break up" (large anchor store, or too many little stores, leaving the shopping center) in the Landlord-Tenant relationship but these are not always easy to get. What is this clause, why can it save your business and why are Landlords reluctant to include it in a lease?
