Are the current Child Support Laws unconstitutional? One Judge seems to think so.
Multnomah County, Oregon, Judge Paula Kurshner believes that by setting a mandatory percentage of a non-custodial parent’s income to be paid in child support to a custodial parent, compared to intact families, with parents married and residing together, where there is no mandatory amount for how much these parents must spend per month on their children, is unfair. It creates a case of one class of citizens being burdened with circumstances that are not imposed on another, which is in direct conflict with our constitution's equal protection clauses. She believes that each parent, non-custodial and custodial share equal financial burden. Also child support should not be used to upgrade the lifestyle of the custodial parent.
