California Bureau of Real Estate Complaince - Use of team names
In this exciting episode of Vondran Legal Hour, Attorney Steve discusses the use of real estate team names, groups and associates and whether or not you need to obtain a DBA (also known as a fictitious business name) before using it. Also, have you considered getting a good domain name, and potentially a trademark for your team name.
Team names in real estate can be used (without the need to file for a DBA) with the County (or Countties) clerks if:
1. Two or more people work in the group, team or association
2. The last name of at least one of the members of the group or team is used in the team name (and the term "group", "team" or "associate" is used)
3. The words "broker" "real estate brokerage" "real estate broker" or "brokerage" are not used creating the impression that the team is an entity indepedent from the brokerage.
For other types of names not meeting this criteria a DBA may need to be filed, and paperwork filed with the Department of Real Estate.
