Here is a basic overview of the California Administrative Procedures Act. When a California DRE licensed sales broker is charged with an accusation alleging they violated the California Real Estate Law (ex. comingling trust fund money, collecting advance fees for loan modifications without a no-objection letter, committing acts of fraud, negligence, etc.) then an accusation gets filed. After the accusation, if the case cannot get settled prior to an administrative hearing in front of the California office of administrative hearings (OAH), then the California Administrative Procedures Act will apply.
