We just got back from a demurrer facing OneWest bank and Deutsche. We have talked about the Robosigner nonsense, notary fraud, and wrongful foreclosure (things the Banks argue cannot be challenged due to the "tender" rule). Well, we just convinced one court we should be allowed to move forward on the wrongful foreclosure cause of action, and the judge agreed over the objections of Senior Counsel for the Banks.
