Federal Lawsuit Filed: Autistic Boy Voted Out of Kindergarten Class

Melissa Barton recently announced the filing of a federal lawsuit against the St. Lucie County Schools in Florida. The lawsuit alleges that her son Alex was kicked out of his kindergarten class last year as a result of his teacher, Wendy Portillo "orchestrating a Survivor-Style vote" asking the boy's classmates to decide whether Alex should be allowed to remain in his class after being sent to the office on two separate occasions for misbehaving. The class voted Alex out 14-2. He has since been diagnosed with Asperger's Syndrome and currently attends a Private School in Palm Beach County on a scholarship.
