A Sunday New York Times report predicts Democrats will use Elena Kagan’s confirmation hearing to attack the Roberts Court. John Wohlstetter, senior fellow at the Discovery Institute and editor of the blog Letter from the Capitol, says that although the Kagan nomination will go as expected, Republicans should counter the Democratic strategy by setting the stage for the fall elections. Wohlstetter says: “Kagan almost surely will be confirmed, barring a major slip. Republicans, however, can make strong public points that set the stage for the fall elections. Liberal judges energize the conservative base.”
