Now that Arizona's illegal-immigration law has passed Racial Profiling has come to the forefront again. Most Americans, do not appear to have a problem with racial profiling, as long as they are not the target. Where is the law when businesses are hiring the so-called Illegal Aliens? Who are the people profiting from selling bogus ID's to the illegals, which include Social Security Cards and Birth Certificates? The businesses are so bold that poor people in Mexico have a list of places to go when the arrive in the United States. Although the name Racial profiling is politically correct, there is nothing new, about the tactic. 
Native Americans were profiled in their own lands, by the Colonizers. Africans were profiled, in Colonial America, even before slave ships arrived. Chinese immigrants were profiled, and portrayed as slant eyed, sneaky people. Of course Europeans were profiled as Civilized Christians, coming to convert the Heathen Natives. So Racial Profiling is nothing new, however it has taken on a name that is more appropriate for the twenty-first century. Isn't it amazing that serial and spree killers are generally white males, yet there is no backlash against them. There is only backlash when a Person of Color seems to be benefiting from Hard Working, God fearing Americans.
Shirley Sherrod is the most recent victim of Racial Profiling, by conservative whites.She was fired after several media organizations posted a doctored video clip of her speaking to a Georgia Chapter of the NAACP. The tape was meant to embarrass the NAACP, and Shirley Sherrod, part of the Collateral Damage.On the edited tape, she tells the group that she did not give a white farmer "the full force of what I could do" after he asked for assistance.The video surfaced days after the NAACP quarreled with Tea Party members over allegations of racism. After the incident was investigated, Ms. Sherrod was offered another position in the Department of Agriculture. This incident did not have the intended effect and actually brought the issue of Racial Profiling to the forefront. It was not Shirley Sherrod who was committing an offense, but the person who edited and distributed the video.
 Racial profiling, for want of a better term, is a Gateway Act -- is a term applied to an act against People of Color. During slavery the race of a person was generally determined by eyeballing them. When Mulattoes and Coloreds started popping up, the race was determined by testimony of whites. A white person could go to court and testified that someone, who may have appeared white, was Mulatto. What was at stake was the freedom of the person, which depended upon their racial status. If the courts found the person to be Mulatto, they were sentenced to serve an Indenture (thirty years for females, twenty years for males). The Free Negro Registry required registration every three years in Colonial Virginia Counties and Cities. The document contained personal information, including the name, age, color, residence, and status. Some  registrations often went further, stating skin color (dark or light mulatto), hair texture and color (straight, kinky, red, or black), height, marks or colors, and the names of parents. 
Today if you are not carrying some form of identification, you can be taken to the Police Department. That seldom happens with a white person who has no ID, but often happens with African Americans and Hispanics. It is understood in African American neighborhoods that you can be taken downtown for little or no reason. What were the consequences of failing to carry the required papers during colonial period? For Free Persons of Color, the worst-case scenario was being sold into slavery. Or they could be thrown in jail until a white person came forward on their behalf.
       With the passing of the Anti Immigrant laws in Arizona, it appears that not too much has changed, except the ethnicity of those targeted. When we speak of slaves in America, an image of Africans comes to mind, but Native Americans were also enslaved. Some say they were not suited for slavery, but the truth is most ran away, or just refused to work  That is something to keep in mind when you see Hispanics, many of whom are Mestizos (Indians), picking our crops. To those who do not know California, Texas (remember the Alamo), New Mexico, and Arizona were a part of Mexico for thousands of years. Yet, those who have been here at the most four hundred years, have claimed the America's as their land. It is a land under the governance of Europeans, but belongs to the original peoples. I am sure if we shared a border with England, we would not have a need for laws to block Illegal. In many ways, it reflects a belief that is rooted in the History of the United States. During slavery, The Free Negro Registry was a means of identifying and tracking so-called Free Persons of Color. 
After the Civil War, racial laws were reversed, only to be revived in 1880 as the Jim Crow laws (named after a black minstrel character). Many of the Jim Crow laws were repealed during the 1960's Civil Rights movement; however, only to resurface again, under the name of racial profiling. These laws are no longer on the books, but they are, “Understood.” The Neo Conservatives continue to call out President Obama by harassing, People of Color, and daring him to speak out in their defense. The subtle tactics used, are no less dangerous, then when they were used during and after slavery. 
It is a call to action against those who do not have the Power of President Obama. There is no justification to target any person or group because of their race, especially in a democratic society. This does not mean that America should be over run with illegal immigrants, but that the law should be applied equally. There are illegal immigrants from all over the world, here in America. The first order of business is to identify who is an illegal immigrant, before dragging people from their homes. They should be given a chance to prove their status, in a court of law. Why not? People are arrested and brought to American Courts from all over the world. If someone is accused of being here illegally, they should have their day in court. We certainly should not celebrate the death of desperate women and children, in an Arizona, Texas, or California desert. 
  The Fourteenth Amendment guarantees every citizen equal protection under the law. 
In Section 1 it states:
       "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law, which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws (1868)." 
        This was supposed to be the law that gave slaves citizenship, and guaranteed them equal protection under the law.  That did not happen and has yet to happen, except when we (African Americans and Hispanics), have marched and protested for our rights. There have been many Civil Rights Movements since the Fourteenth Amendment was passed in 1868.  The one thing we have not had is an open and honest conversation on race, here in America.
           The Fourteenth Amendment is all well and good for those who can afford to go to court and prove their rights were violated. Many of the people targeted, do not have the resources or the time to do this. Now that there is an outcry from the American Civil Liberties Union, and other civil rights organizations, racial profiling has become more subtle.  Every American should be concerned when our rights are chipped away, laws are set aside, and citizens are detained for no reason. Until there is some type of referendum and a movement to abolish laws that target American Citizens, whether these laws are written or unwritten, we will remain a country stuck in the past.
