In this episode, we will continue our discussion on MERS and Assignment of Mortgages. Whether your mortgage was assigned to another lender or securitized investment trust, the argument will be similar. The difference being the illumination of the trusts with the PSA which dictates when the asset (your mortgage note) should have been in the trust.
If your mortgage and note has been transferred to another entity, then, you will need to focus on MERS and whether an assignment of mortgage or security deed from MERS to another entity empowers that entity to foreclose when the entity does not hold the note.
